Justice R.BASANT\n\n Dated :28\/01\/2009\n\n O R D E R\n                             R.BASANT, J\n                          ----------------------\n                       Tr.P.Crl.No.93 of 2008\n                    ----------------------------------------\n              Dated this the 28th day of January 2009\n\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for<\/p>\n<p>offences punishable under Section                  138 of the Negotiable<\/p>\n<p>Instruments Act.       According to the petitioner, the entire<\/p>\n<p>transaction took place within the jurisdiction of Tirur police<\/p>\n<p>station with a branch of the complainant at Tirur. The complaint<\/p>\n<p>has been filed before the learned J.F.C.M-II Thrissur solely on<\/p>\n<p>the basis of the assertion that the collection bank is the<\/p>\n<p>Dhanalakshmi Bank Limited at Thrissur. Solely on this assertion,<\/p>\n<p>jurisdiction is conferred to the learned J.F.C.M-II, Thrissur.<\/p>\n<p>      2.   The learned counsel for the petitioner submits that in<\/p>\n<p>the light of the decision in <a href=\"\/doc\/912736\/\">Santhoshkumar v. K.G.Mohanan<\/a><\/p>\n<p>[2008(3) KLT 461], the averments in the complaint are<\/p>\n<p>insufficient to confer jurisdiction on the learned J.F.C.M-II<\/p>\n<p>Thrissur. The learned counsel for the respondent accepts this<\/p>\n<p>submission and I am satisfied that, in the nature of the<\/p>\n<p>averments in the complaint, the transfer prayed for is absolutely<\/p>\n<p>justified.\n<\/p>\n<p><span class=\"hidden_text\">Tr.P.C.No.93\/08                    2<\/span><\/p>\n<p>       3.    In the result,<\/p>\n<p>       a)    This transfer petition is allowed.<\/p>\n<p>       b)    S.C.No.3699\/05 pending before the learned J.F.C.M-II<\/p>\n<p>Thrissur is transferred to the court of the learned J.F.C.M, Tirur.<\/p>\n<p>       c)    Parties shall appear personally or through counsel<\/p>\n<p>before the transferee court without waiting for any further<\/p>\n<p>directions on 24\/2\/2009. Considering the long pendency of the<\/p>\n<p>matter, the learned J.F.C.M Tirur shall proceed to dispose of the<\/p>\n<p>case as expeditiously as possible, at any rate, within a period of<\/p>\n<p>four months from the date of appearance.<\/p>\n<p>       4.    The learned J.F.C.M-II, Thrissur shall forthwith<\/p>\n<p>transmit records to the learned J.F.C.M, Tirur such that the<\/p>\n<p>records shall be available before court on 24\/2\/2009.<\/p>\n<p>       Hand over copy of this order to the learned counsel for the<\/p>\n<p>petitioner. Communicate copy to both courts.
