Four<\/p>\n<p>lakhs from the second respondent Bank on the petitioners&#8217;<\/p>\n<p>creating security interest over the property in question belonging<\/p>\n<p>to the    second petitioner.                          But the fact remains that the<\/p>\n<p>petitioners were not eager to clear the liability in time, under<\/p>\n<p>which circumstances, the Bank declared the account as &#8216;NPA&#8217; and<\/p>\n<p>proceeded with further steps, which forms the subject matter of<\/p>\n<p>challenge in this Writ Petition.\n<\/p>\n<p>      2. The learned Counsel for the petitioners submits that the<\/p>\n<p>default   was never wilful                   and the petitioners are ready and<\/p>\n<p>willing to clear the entire liability, provided some breathing time<\/p>\n<p>is given in this regard                    and that the petitioners might be<\/p>\n<p>permitted to continue to enjoy the benefit of the loan account<\/p>\n<p>after getting it regularised.\n<\/p>\n<p> W.P.(C) No. 8976 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      3. The learned Counsel for the respondent Bank submits<\/p>\n<p>that a sum of Rs. One Lakh Five thousand is &#8216;overdue&#8217; towards<\/p>\n<p>defaulted installments and unless and until the said amount is<\/p>\n<p>cleared forthwith, the request of the petitioners for having the<\/p>\n<p>loan account regularised is not liable to be entertained.<\/p>\n<p>      4. After hearing both the sides, this Court finds that the<\/p>\n<p>loan being in the Housing Sector, an opportunity to clear the<\/p>\n<p>overdue amount and to have the loan account regularised        can<\/p>\n<p>be given. Accordingly, the petitioners are permitted to clear the<\/p>\n<p>&#8216;overdue&#8217; amount by way of &#8216;two&#8217; equal monthly installments,<\/p>\n<p>the first of which shall be paid on or before 15.04.2010 and the<\/p>\n<p>second one on or before 15.05.2010.      It is also made clear that<\/p>\n<p>the petitioners shall continue to effect the regular E.M.Is     as<\/p>\n<p>originally stipulated, besides clearing the arrears as above. The<\/p>\n<p>loan will    stand regularised accordingly and all coercive<\/p>\n<p>proceedings shall be kept in abeyance for the time being. It is<\/p>\n<p>further made clear that if the petitioners commit any default in<\/p>\n<p>remitting the overdue amounts\/arrears as above or in the event<\/p>\n<p>of committing two consecutive defaults in respect of the regular<\/p>\n<p>  W.P.(C) No. 8976 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>E.M.Is payable, the respondent Bank will be at liberty to proceed<\/p>\n<p>with further steps for realisation of the entire outstanding liability<\/p>\n<p>in a lump sum, pursuing the coercive steps, from the stage where<\/p>\n<p>it stands now.\n<\/p>\n<p>      The Writ Petition is disposed of.\n<\/p>\n<\/p>\n<p>                                  P.R.
