Heard learned counsel appearing on behalf<\/p>\n<p>                   of   the    petitioner       and     the   learned     counsel<\/p>\n<p>                   appearing on behalf of the State.\n<\/p>\n<p>                              The petitioner apprehends his arrest in<\/p>\n<p>                   Chapra      Town      P.S.Case         No.164     of      2007<\/p>\n<p>                   (U.T.No.312\/2009)      for     the    offences    punishable<\/p>\n<p>                   under sections 498A, 304B\/34 of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                              Learned    counsel        for   the    petitioner<\/p>\n<p>                   submits that the marriage between the petitioner<\/p>\n<p>                   and the     victim lady Manju Devi took place in<\/p>\n<p>                   March    2002.   It   is   submitted       that   it   was   an<\/p>\n<p>                   accidental death by burn injury and for which<\/p>\n<p>                   initially information was given by the father of<\/p>\n<p>                   the victim girl on 31.5.2007 placed at Annexure-2<\/p>\n<p>                   of the present application. The father of the<\/p>\n<p>                   victim lady, i.e. wife of the petitioner, has<\/p>\n<p>                   categorically stated in the said fardbeyan that<\/p>\n<p>                   his daughter caught fire in course of cooking and<\/p>\n<p>                   that this petitioner also got burn injury in the<\/p>\n<p>                   process of saving her and they were both admitted<\/p>\n<p>                   in the general ward of the hospital. It is stated<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>that the father of the victim girl having given<\/p>\n<p>this   statement         on    31.5.2010          changed         his   stand<\/p>\n<p>after the death of his daughter and instituted<\/p>\n<p>the present case giving rise to the Case No.164<\/p>\n<p>of   2007      which     was    subsequently                registered      as<\/p>\n<p>F.I.R.      under      section        156(3)       of       the     Code    of<\/p>\n<p>Criminal          Procedure.               The         police,          after<\/p>\n<p>investigation,           submitted         final        form       which    is<\/p>\n<p>placed    at     Annexure-4.          The    informant,            i.e.    the<\/p>\n<p>father      of    the     victim       girl        filed       a     protest<\/p>\n<p>petition and upon which the cognizance was taken<\/p>\n<p>against     the      accused     persons          which       led     to   the<\/p>\n<p>filing of the present application.<\/p>\n<p>            Learned counsel, thus, submits that the<\/p>\n<p>initial     statement          made    by        the    father       of    the<\/p>\n<p>victim on 31.5.2007, i.e while the wife of the<\/p>\n<p>petitioner       was     alive,       is    by    itself          sufficient<\/p>\n<p>proof of the non-involvement of the petitioner in<\/p>\n<p>the alleged offence.\n<\/p>\n<pre>            Taking            into           consideration                 the\n\ncircumstances          and     submissions             of    the     learned\n\ncounsel,       let     petitioner          Jitendra          Pandit     alias\n\n<\/pre>\n<p>Mantu Pandit alias Jitendra Kumar, in the event<\/p>\n<p>of his arrest or surrender within four weeks from<\/p>\n<p>the date of receipt\/production of a copy of this<\/p>\n<p>order, be released on furnishing bail bond of<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>      Rs.10,000\/- (ten thousand) with two sureties of<\/p>\n<p>      the like amount each to the satisfaction of Sri<\/p>\n<p>      Rakesh Mishra, Judicial Magistrate, Ist class,<\/p>\n<p>      Chapra in connection with Chapra Town P.S.Case<\/p>\n<p>      No.164 of 2007, subject to the conditions as laid<\/p>\n<p>      down under section 438(2) of the Code of Criminal<\/p>\n<p>      Procedure.\n<\/p>\n<\/p>\n<pre>ahk                        (Jyoti Saran, J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jitendra Pandit @ Mantu Pandit @ &#8230; vs State Of Bihar on 11 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
