The detaining authority took into consideration one<br \/>\noffence registered against the petitioner under the Bombay<br \/>\nProhibition Act (hereinafter referred to as  the Act ). The<br \/>\nauthority also recorded in its reasons that the activity of the<br \/>\ndetenu was detrimental to public health and public order and it was<br \/>\nnot possible to deter him from the activities by following the<br \/>\nregular procedure of law.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate for the petitioner has, leaving aside the other contentions<br \/>\nraised in the petition, emphasized on the fact that only one offence<br \/>\nis registered against the detenu and he is labelled as a Bootlegger.<br \/>\nThere is no other material on record to show that the petitioner is<br \/>\ninvolved in any other offence of similar nature to show that he is<br \/>\nrepetitively engaged in Bootlegging and therefore, the subjective<br \/>\nsatisfaction that the petitioner is a Bootlegger is without any<br \/>\nfoundation which would vitiate the entire order.\n<\/p>\n<p>3.\tIt<br \/>\nis also contended that there is no material with the detaining<br \/>\nauthority to record the satisfaction that the activity of the<br \/>\npetitioner was detrimental to public health or public order. The<br \/>\nmaterial seized is not shown by any test to be detrimental to public<br \/>\nhealth and therefore also, the order gets vitiated.\n<\/p>\n<p>4.\tLearned<br \/>\nAGP has opposed this petition.\n<\/p>\n<p>5.\tWhen<br \/>\nthe detaining authority has relied only on one offence registered<br \/>\nagainst the petitioner under the Bombay Prohibition Act to label him<br \/>\nas a Bootlegger, it is not possible to uphold the satisfaction as the<br \/>\nregistration of single offence would not mean that it is the<br \/>\npetitioner&#8217;s usual activity. He would, therefore, not fall within the<br \/>\ndefinition of a Bootlegger.\n<\/p>\n<p>6.\tFurther<br \/>\nthe satisfaction about the activity of the petitioner being<br \/>\ndetrimental to public health and public order is not supported by any<br \/>\ncogent material like Chemical Examiner&#8217;s report or other material to<br \/>\nshow that the material seized was dangerous to the public health.\n<\/p>\n<p>7.\tThe<br \/>\nApex Court in the case of <a href=\"\/doc\/748067\/\">District Collector, Ananthapur Vs. V.<br \/>\nLaxmanna,<\/a> reported in (2005) 3 SCC 663 has taken a view and<br \/>\ntherefore, attracting the provisions of the Act, the detaining<br \/>\nauthority must be satisfied on material available to it (such as<br \/>\nreport of Chemical Examiner) that the arrack dealt with by the detenu<br \/>\nis dangerous to public health. In this case, no such material is on<br \/>\nrecord and in this count also, the subjective satisfaction of the<br \/>\ndetaining authority gets vitiated.\n<\/p>\n<p>8.\tThe<br \/>\npetition, therefore, deserves to be allowed and the same is allowed.<br \/>\nThe order dated 20.8.2010  detaining the detenu   Dilipbhai alias<br \/>\nDevo Popatbhai Thakore passed by the Police Commissioner, Ahmedabad<br \/>\nCity impugned in the petition is hereby set aside. The detenu be set<br \/>\nat liberty forthwith, if not required in any other case. Rule is made<br \/>\nabsolute. No costs.
