Justice ANTONY DOMINIC\n\n Dated :29\/08\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n\n           --------------------------------------------------------\n\n                     W.P.(C) 18808 of 2008\n\n           --------------------------------------------------------\n\n                   Dated: AUGUST 29, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>     Renewal of permit sought for by the petitioner was<\/p>\n<p>rejected by Ext.P1 proceedings of the RTA on the ground of<\/p>\n<p>delay.   Against that order, petitioner filed Ext.P2 appeal<\/p>\n<p>producing a medical certificate which certified that he was<\/p>\n<p>laid up during the period in question.                    That appeal was<\/p>\n<p>considered and was rejected by Ext.P4.                    According to the<\/p>\n<p>petitioner, though he had filed an application for<\/p>\n<p>condonation of delay before the RTA, the reason stated by<\/p>\n<p>him was not considered while Ext.P1 order was passed. It<\/p>\n<p>is also contended that though the medical certificate<\/p>\n<p>produced has been referred to in Ext.P4, the acceptability<\/p>\n<p>or  otherwise of that has not been dealt with in Ext.P4<\/p>\n<p>judgment.\n<\/p>\n<p>     2. I am inclined to agree with the learned counsel in<\/p>\n<p>the submissions made by him and, in my view, the matter<\/p>\n<p>WP(C) 18808\/08<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>needs to be reconsidered by the primary authority.      In<\/p>\n<p>order to do so, I quash Exts.P1 and P4 and direct that the<\/p>\n<p>primary authority shall reconsider the matter.<\/p>\n<p>     3.   Petitioner shall produce a copy of the medical<\/p>\n<p>certificate  before the RTA and thereupon the matter will<\/p>\n<p>be reconsidered.
