Justice K.HEMA\n\n Dated :25\/06\/2008\n\n O R D E R\n                              K.HEMA, J.\n\n                  -----------------------------------------\n                        B.A.No. 4061 of 2008\n                  -----------------------------------------\n\n             Dated this the 25th day of June, 2008\n\n                               O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2. The alleged offences are under Sections 466, 468 and 471<\/p>\n<p>of the Indian Penal Code and 12(b) the Passport Act, 1967.<\/p>\n<p>According to prosecution, various documents were forged by the<\/p>\n<p>accused to obtain a fake passport and the petitioner is the third<\/p>\n<p>accused in the crime. The offences were allegedly committed in<\/p>\n<p>1993.\n<\/p>\n<p>     3. Learned counsel for petitioner submitted that the petitioner<\/p>\n<p>is aged 82 years and he is sick and he has lot of physical problems,<\/p>\n<p>including cancer. He had also undergone a recent surgery. He also<\/p>\n<p>submitted that the petitioner is totally innocent of the allegations<\/p>\n<p>made, as revealed from Annexures A1 to A5 produced. Though the<\/p>\n<p>alleged offence took place about 15 years back, police is seeking to<\/p>\n<p>arrest the petitioner only now.\n<\/p>\n<p>     4. Learned Public Prosecutor submitted that accused 1 and 2<\/p>\n<p>were arrested and released on bail and accused No.4 was arrested,<\/p>\n<p>but he was hospitalised. An attempt was made to arrest the<\/p>\n<p><span class=\"hidden_text\">     BA.4061\/08                     2<\/span><\/p>\n<p>petitioner, but because of his ailment and physical condition, he<\/p>\n<p>could not be arrested, it is submitted.<\/p>\n<p>      5. In the above circumstances, I find that the petitioner can be<\/p>\n<p>granted anticipatory bail, taking into consideration the physical<\/p>\n<p>condition of the petitioner.\n<\/p>\n<p>      Hence, the following order is passed:\n<\/p>\n<p>             In the event of arrest, the petitioner shall be<\/p>\n<p>      released on bail       on his executing a bond for<\/p>\n<p>      Rs.50,000\/- with two solvent sureties each for the<\/p>\n<p>      like sum to the satisfaction of the arresting officer,<\/p>\n<p>      on condition that he will co-operate with the<\/p>\n<p>      investigation.\n<\/p>\n<p>      This petition is allowed.\n<\/p>\n<\/p>\n<p>                                   K.HEMA, JUDGE<\/p>\n<p>vgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kunjumoidu vs State Of Kerala on 25 June, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4061 of 2008() 1.
