Justice T.R.RAMACHANDRAN NAIR\n\n Dated :11\/01\/2010\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR, J.\n             ------------------------------------------------\n                   W.P.(C)No.34992 of 2009\n             ------------------------------------------------\n          Dated this the 11th day of January, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>          The petitioner is an aspirant for suitable employment<\/p>\n<p>and has received the admit card to serve in the Army as<\/p>\n<p>evidenced from Ext.P1. The petitioner requires production of<\/p>\n<p>Police Clearance Certificate for joining the employment. When<\/p>\n<p>the petitioner made a request before the respondent he was<\/p>\n<p>informed that he is involved in Crime No.91\/2002 for the<\/p>\n<p>offences punishable under Sections 454, 461, 380 and 34 I.P.C.<\/p>\n<p>The petitioner was a Juvenile at that time.<\/p>\n<p>     2.    It is the case of the petitioner that the petitioner has<\/p>\n<p>not received any summons in any case so far. Even though he<\/p>\n<p>filed Criminal M.C.No.3700 of 2009 that was disposed on<\/p>\n<p>25\/11\/2009 recording the submission of the prosecutor that<\/p>\n<p>charge sheet has been filed before the concerned court. In<\/p>\n<p>these circumstances, petitioner has filed this writ petition.<\/p>\n<p>From the report forwarded by the Chief Judicial Magistrate,<\/p>\n<p>Ernakulam, it is seen that alleging offence under Sections 454,<\/p>\n<p>461, 380 and 34 I.P.C. the Koothattukulam Police Station has<\/p>\n<p>registered a case as Crime No.91\/2002 against the petitioner.<\/p>\n<p>W.P.(C)No.34992 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>The charge against him was filed before the Juvenile Justice<\/p>\n<p>Board (C.J.M.Court, Ernakulam) only on 26\/12\/2009. Now the<\/p>\n<p>same has been taken on file as C.C.No.1\/2010 and was posted on<\/p>\n<p>8\/1\/2010 for appearance of the Juvenile.\n<\/p>\n<p>     3.    The petitioner has to approach the learned Chief<\/p>\n<p>Judicial Magistrate, Ernakulam for getting appropriate orders.<\/p>\n<p>If the petitioner files an application before the said Court, the<\/p>\n<p>same will be considered and appropriate action will be taken in<\/p>\n<p>view of the fact that the petitioner has to produce Police<\/p>\n<p>Clearance Certificate for joining Army Service.
