Shah for applicants and learned<br \/>\nadvocate Mr.K.R.Dave for respondent.\n<\/p>\n<p>2.\tConsidering<br \/>\nthe averments made in present application, Second Appeal No.216 of<br \/>\n2008 is fixed for final hearing in 1st week of May,2011.\n<\/p>\n<p>3.\tThis<br \/>\nCourt has passed the order in Civil Application No.10799 of 2008 on<br \/>\n2.7.2009 which is quoted as under :\n<\/p>\n<p>&#8220;1.\tRule.\n<\/p>\n<p>Learned advocate Mr. Dave, waives service of notice of Rule on behalf<br \/>\nof  the opponent.\n<\/p>\n<p>2.\tWith<br \/>\nthe consent of learned advocates for the parties,  this application<br \/>\nis taken up for final hearing today.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr. Vasant S. Shah for the applicants and learned<br \/>\nadvocate Mr. K.R.  Dave  for the opponent.\n<\/p>\n<p>4.\tBy<br \/>\nway of this application, the applicants have sought stay of the<br \/>\nimplementation, execution and operation of the judgment and decree<br \/>\npassed by the First Appellate Court.\n<\/p>\n<p>5.\tBy<br \/>\nthe order dated 18-9-2008  this Court, stayed the execution,<br \/>\noperation and operation of the judgment and decree  dated 29-1-2008<br \/>\npassed by the learned Additional District Judge, Fast Track Court<br \/>\nNo.1, Surendranagar in Regular Civil Appeal No. 23 of 2006.\n<\/p>\n<p>6.\tIn<br \/>\nview of the fact that the money decree is passed against the<br \/>\napplicants, no blanket stay against  the execution of the  decree can<br \/>\nbe granted. Hence, the execution, operation and implementation of the<br \/>\njudgment and decree  dated 29-1-2008 passed by the learned Additional<br \/>\nDistrict Judge, Fast Track Court No.1, Surendranagar in Regular Civil<br \/>\nAppeal No. 23 of 2006 is stayed on the condition that the applicants<br \/>\ndeposit the decreetal amount before the trial court within 8 weeks<br \/>\nfrom today.\n<\/p>\n<p>7.\tIn<br \/>\nview of above, this application stands allowed. Rule is made absolute<br \/>\nto the aforesaid extent, with no order as to costs.&#8221;\n<\/p>\n<p>4.\tIn<br \/>\npursuance to aforesaid order, learned advocate Mr.Shah submitted that<br \/>\napplicants have deposited the amount before the trial Court.<br \/>\nTherefore, he is having apprehension that respondent may withdraw the<br \/>\nsaid amount which has been deposited by applicants before the trial<br \/>\nCourt.\n<\/p>\n<p>5.\tAs<br \/>\nand when such application is filed by respondent for withdrawal of<br \/>\naforesaid amount from trial Court, it is open for applicants to raise<br \/>\nobjection against such application, if it is filed by respondent<br \/>\nbefore trial Court. Ultimately, the trial Court has to decide such<br \/>\napplication which has been filed by respondent.\n<\/p>\n<p>6.\tAccordingly,<br \/>\npresent application is disposed of.
