Justice ANTONY DOMINIC\n\n Dated :12\/08\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J\n\n     -----------------------------------------------------------\n                     W.P.(C).No.23997\/2008\n     -----------------------------------------------------------\n           Dated this the 12th     day of August, 2008\n\n\n                            JUDGMENT\n<\/pre>\n<p>     Challenge in this writ petition is against the revenue<\/p>\n<p>recovery proceedings initiated against the petitioner by<\/p>\n<p>Exts.P2 and P3. Petitioner was one of the respondents<\/p>\n<p>before the MACT, Muvattupuzha in OP(MV).No.945\/2003, he<\/p>\n<p>being the registered owner of the vehicle involved in the<\/p>\n<p>accident. He remained ex-parte before the Tribunal. The<\/p>\n<p>Tribunal by Ext.P4 award rendered on 20th February, 2007,<\/p>\n<p>awarded compensation. The award, as               at present, has<\/p>\n<p>become final and in terms thereof the petitioner is liable to<\/p>\n<p>pay the amount due. If that be so, I cannot find anything<\/p>\n<p>irregular in Exts.P2 and P3 recovery proceedings initiated for<\/p>\n<p>realisation of the compensation awarded.<\/p>\n<p><span class=\"hidden_text\">WP(c).No.23997\/2008          2<\/span><\/p>\n<p>      2. Now the counsel for the petitioner only seeks an<\/p>\n<p>instalment facility to pay the amount. It being an accident in<\/p>\n<p>January, 2003 and the award being of 2007 February, I do<\/p>\n<p>not think that any easy instalment facility sought for by the<\/p>\n<p>petitioner can be granted.
