(J)\n\nCITATION:\n 1995 SCC  (1) 304\t  JT 1995 (1)\t405\n 1994 SCALE  (5)123\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nB.P JEEVAN REDDY, J.- Leave granted.\n<\/p>\n<p>2.Section  90  of the Punjab Municipal\tCorporation  Act,<br \/>\n1976  empowers\tthe Corporation to levy inter  alia  octroi.<br \/>\nSections 11 3 to 116 provide for the levy and collection  of<br \/>\noctroi.\t Section 113 says that the octroi shall be levied at<br \/>\nthe   rates  specified\tby  the\t Government.   Section\t 114<br \/>\nobligates  every  person bringing or  receiving\t within\t the<br \/>\noctroi\tlimits\tof any city any article on which  octroi  is<br \/>\npayable\t to  allow the same to be  inspected,  examined\t and<br \/>\nweighed by the officer of the Corporation and to communicate<br \/>\nto  the officer such information or other documents  in\t his<br \/>\npossession  as\tmay  be\t called for  by\t him.\tSection\t 115<br \/>\nprovides  that any person refusing to permit the officer  to<br \/>\ninspect, weigh or otherwise examine the goods being  brought<br \/>\nin shall be liable to be punished with fine which may extend<br \/>\nto Rs 50.  Section 116, which is relevant for our  purposes,<br \/>\nprovides that any person bringing the goods or who abets the<br \/>\nbringing  in of goods into octroi limits without payment  of<br \/>\nduty  shall be punishable with fine.  The section  reads  as<br \/>\nfollows:\n<\/p>\n<blockquote><p>\t      &#8221;\t 116.\tPenalty for evasion of\toctroi.-  If<br \/>\n\t      animals or articles passing the octroi  limits<br \/>\n\t      of a corporation are liable to the payment  of<br \/>\n\t      octroi  then every person who causes or  abets<br \/>\n\t      the introduction of,- or himself introduces or<br \/>\n\t      attempts\tto introduce within the said  octroi<br \/>\n\t      limits any such animals or articles upon which<br \/>\n\t      payment of the octroi due on such introduction<br \/>\n\t      has  neither been made nor tendered, shall  be<br \/>\n\t\t\t    punishable\twith fine which may extend  either<br \/>\n\t      to twenty times the value of such\t  octroi  or<br \/>\n\t      to fifty rupees, whichever may be greater.&#8221;\n<\/p><\/blockquote>\n<p>3. The Punjab and Haryana High Court has held that the\tfine<br \/>\ncontemplated  by  Section  116\tcan be\timposed\t only  by  a<br \/>\ncriminal  court\t and  not by an\t officer  of  the  Municipal<br \/>\nCorporation. The correctness of the said view is questioned.<br \/>\nSo  far\t as  the levy of octroi is concerned,  there  is  no<br \/>\ndispute that it can be assessed, collected and recovered  by<br \/>\nthe  officers  of the Corporation. Indeed  it  is  generally<br \/>\ncollected at the point of entry itself. The only dispute  is<br \/>\nwith  respect to the levy of fine under Section\t 116,  which<br \/>\ncan  extend either to twenty times the value of\t the  octroi<br \/>\nevaded\tor  attempted to be evaded or Rs  50,  whichever  is<br \/>\nhigher.\n<\/p>\n<p>4.Sections  113\t to 116 occur in Chapter  VII  dealing\twith<br \/>\n`Taxes&#8217;. Indeed there are other provisions in the Act  which<br \/>\nprovide punishment for certain offences created by the\tAct.<br \/>\nReference may be made to Section 388 which says that whoever<br \/>\ncontravenes  the  provisions  specified\t therein  &#8220;shall  be<br \/>\npunishable  (i) with fine which may extend to the  amount,<br \/>\nor  with  imprisonment for a term which may  extend  to\t the<br \/>\nperiod, specified in that behalf&#8230;&#8230;&#8221;.\n<\/p>\n<p>5.   Section 394-A says:\n<\/p>\n<blockquote><p>\t      &#8220;394-A.\tProsecutions.-\tSave  as   otherwise<br \/>\n\t      provided\tin this Act, no court shall try\t any<br \/>\n\t      offence  made punishable by or under this\t Act<br \/>\n\t      or  any rule or any bye-law  made\t thereunder,<br \/>\n\t      except   on   the\t complaint   of,   or\tupon<br \/>\n\t      information  received from  the  Commissioner,<br \/>\n\t      the Executive<br \/>\n<span class=\"hidden_text\">\t      306<\/span><br \/>\n\t      Officer,\tthe Medical Officer of\tHealth,\t the<br \/>\n\t      Municipal Engineer (Electricity) or any  other<br \/>\n\t      officer of the Corporation authorised by it in<br \/>\n\t      this behalf.&#8221;\n<\/p><\/blockquote>\n<p>6.   It\t appears that the Punjab and Haryana High Court\t has<br \/>\nconsistently  taken  the view that the\timposition  of\tfine<br \/>\nunder  Section 116 (and the corresponding provision  in\t the<br \/>\npreceding  enactments) can be only by a criminal court\tvide<br \/>\nNitco  Roadways\t (P) Ltd. v. Municipal Corpn.  of  Ludhiana1<br \/>\ndisposed of on 4-9-1985 and Gian Chand v. State2.  We are of<br \/>\nthe  opinion  that  the said view is correct  in  law.\t The<br \/>\nnormal rule of legislative drafting is that wherever it says<br \/>\nthat  a particular Act shall be &#8220;punishable with  fine&#8221;,  it<br \/>\ncontemplates  its imposition by a criminal court  only.\t  Be<br \/>\nthat  as  it  may,  both  Sections  116\t and  388  speak  of<br \/>\n&#8220;punishable  with fine&#8221;.  Section 388 provides not only\t for<br \/>\nfine but also for imprisonment.\t It cannot be suggested that<br \/>\nthe  punishment of imprisonment contemplated by Section\t 388<br \/>\ncan  be awarded by the officers of the Corporation.  If\t so,<br \/>\nthe punishment of fine can also not be imposed by them.\t The<br \/>\nsame  logic applies to Section 116 as well.  We,  therefore,<br \/>\nagree  with the High Court that punishment of fine  provided<br \/>\nby Section 116 can be imposed only by the criminal court and<br \/>\ncannot be imposed by the officers of the Corporation.\n<\/p>\n<p>7.   The  appeal  accordingly fails and\t is  dismissed.\t  No<br \/>\ncosts.\n<\/p>\n<p><span class=\"hidden_text\">307<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Municipal Corpn vs Commr.
