           Appellant\/petitioner is aggrieved by the judgment of<\/p>\n
the learned Single Judge in W.P.(C) No.25335\/08.              The writ<\/p>\n
petition was filed      challenging      the orders regarding the<\/p>\n
disciplinary proceedings initiated against the petitioner.        The<\/p>\n
disciplinary proceedings culminated in barring of two increments<\/p>\n
with cumulative effect, and recovery. The main challenge is on<\/p>\n
the punishment of barring of two increments with cumulative<\/p>\n
effect. According to the petitioner, since the proposal was only to<\/p>\n
impose a punishment of barring of two increments without<\/p>\n
cumulative effect, the Director of Civil Supplies could not have<\/p>\n
imposed a punishment of barring of two increments with<\/p>\n
cumulative effect. In order to appreciate the above contention, a<\/p>\n
brief reference to the facts is necessary.\n<\/p>\n
           2. While the petitioner was working as Upper Division<\/p>\n
Clerk in the Civil Supplies Department, he was sent on deputation<\/p>\n
to the Kerala State Civil Supplies Corporation. During deputation,<\/p>\n
he was put in charge of the Shop Manager of a Maveli Store.<\/p>\n

Alleging     several     irregularities   including      temporary<\/p>\n
misappropriation, disciplinary proceedings were initiated against<\/p>\n
him and he was served with a memo of charges dated 23.7.1993.<\/p>\n
The Regional Manager of the Civil Supplies Corporation, after<\/p>\n
considering the explanation offered by the petitioner, made a<\/p>\n
proposal to recover an amount of Rs.54,916\/-, and imposed a<\/p>\n
minor penalty of stoppage of two increments without cumulative<\/p>\n
effect, as per Ext.P2 letter addressed to the Director of Civil<\/p>\n
Supplies. That letter happened to be addressed to the Director of<\/p>\n
Civil Supplies since by the time the proceedings were completed,<\/p>\n
the writ petitioner had already been repatriated to the Civil<\/p>\n
Supplies Department in August, 1993. However, it is significant<\/p>\n
to refer to paragraph 9 of the letter, wherein it is stated that the<\/p>\n
writ petitioner had no satisfactory explanation for the temporary<\/p>\n
misappropriation. The Regional Manager also was of the view<\/p>\n
that “the irregularities committed by Sri.M.P.Madhusoodhanan<\/p>\n
formerly Shop Manager of the Hevel Mobile Maveli Kalpetta and<\/p>\n
Hevel Maveli Store Meppady are very grave in nature and<\/p>\n
warrants deterrent punishment. His ill deeds are a high handed<\/p>\n
one and cannot be viewed lightly.”     However, the proposal was<\/p>\n

only to recover the loss sustained to the Corporation and to bar<\/p>\n
two increments without cumulative effect. The Director, however<\/p>\n
passed Ext.P3 order barring two increments with cumulative<\/p>\n
effect and ordering recovery of the loss with interest.       The<\/p>\n
petitioner pursued the matter in appeal before the second<\/p>\n
respondent Board of Revenue. The same was rejected, leading to<\/p>\n
Ext.P4 order passed by the Board of Revenue. Pursuant to the<\/p>\n
remand as per Ext.P4, the Director again passed Ext.P5 order<\/p>\n
sustaining the punishment of barring of two increments with<\/p>\n
cumulative effect and ordering recovery of loss with interest. The<\/p>\n
matter was pursued before the Commissioner, Civil Supplies. The<\/p>\n
punishment regarding the recovery was slightly reduced. Still<\/p>\n
further, the petitioner pursued the matter before the Government<\/p>\n
leading to Ext.P7 order.      The Government found that the<\/p>\n
punishment was justified in view of the repeated damage caused<\/p>\n
by the writ petitioner to the Corporation and also the<\/p>\n
misappropriation. Now the contention advanced by the learned<\/p>\n
counsel for the appellant\/petitioner is that since the petitioner<\/p>\n
was on deputation to the Civil Supplies Corporation and since the<\/p>\n
controlling authority in the Corporation had proposed a<\/p>\n

punishment only of barring of two increments without cumulative<\/p>\n
effect, the Director of Civil Supplies could not have imposed a<\/p>\n
different punishment. In case the Director had any disagreement<\/p>\n
with the punishment proposed, he should have made another<\/p>\n
proposal and not imposition of a different punishment.<\/p>\n
            3.     We are afraid, the contentions cannot be<\/p>\n
appreciated.     Under Rule 19(2)(i) of the Kerala Civil Services<\/p>\n
(Classification, Control and Appeal) Rules, 1960, if the borrowing<\/p>\n
authority is of the opinion that any of the penalties specified in<\/p>\n
items (i) to (iv) of Rule 11(1) (minor penalties) should be imposed<\/p>\n
on the person on deputation, the borrowing authority may do so<\/p>\n
in consultation with the lending authority. The proviso has also<\/p>\n
made it clear that in the event of any difference of opinion<\/p>\n
between the borrowing authority and the lending authority, the<\/p>\n
services of the Government servant shall be placed at the<\/p>\n
disposal of the lending authority. In the instant case, by the time<\/p>\n
the disciplinary proceedings had already been concluded, except<\/p>\n
the stage of imposition of the punishment, the petitioner had<\/p>\n
already been sent back to the Civil Supplies Department.<\/p>\n
Therefore, at the time of imposition of the punishment, the<\/p>\n

employee is under the Department. What is material is the time<\/p>\n
and stage of imposition of the punishment, under Rule 19(2) (i).<\/p>\n
Even otherwise, in a situation of difference of opinion between<\/p>\n
the borrowing authority and the lending authority, it is the view<\/p>\n
of the lending authority that has to be accepted and<\/p>\n
implemented.     In the instant case, on both counts, the writ<\/p>\n
petitioner is not entitled to succeed. At the time of imposition of<\/p>\n
the punishment, the writ petitioner had already been repatriated<\/p>\n
to the Department. Even if there is any difference of opinion<\/p>\n
between the view that is expressed by the Regional Manager of<\/p>\n
the Civil Supplies Corporation and that of the Department, it is<\/p>\n
the opinion of the lending authority that has to be accepted and<\/p>\n
the matter has to be governed by that opinion. That is all what<\/p>\n
has been done in the instant case. Thus, there is no merit in the<\/p>\n
appeal. It is dismissed.\n<\/p>\n<\/p>\n
