Opposite parties\n\n                                ------------\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard Counsel for the petitioner and the Standing Counsel on<br \/>\nbehalf of the respondents.\n<\/p>\n<p>      Petitioner has filed this writ petition against the order of<br \/>\nsuspension dated 31.12.2008 as also the order dated 2.1.2009<br \/>\nasking the petitioner to vacate the house.\n<\/p>\n<p>      Counsel for the petitioner contends that law is well settled that<br \/>\na government servant cannot be kept under suspension for an<br \/>\nindefinite period. In the instant case the petitioner was placed under<br \/>\nsuspension by the order dated 2.1.2009 but              till date no charge<br \/>\nsheet has been issued.\n<\/p>\n<p>      No doubt suspension is not a punishment but it is equally true<br \/>\nthat a government employee cannot be placed under suspension for<br \/>\nan indefinite period. Whenever an employee is suspended, he is<br \/>\nlooked with suspicious eyes by his relatives, colleagues and the<br \/>\nsociety at large apart from the mental agony with which the<br \/>\nemployee suffers. It has also been pointed out that the petitioner is<br \/>\nunnecessarily   being      harassed   and      victimized   on     account   of<br \/>\nabsolutely unjustified suspension order.\n<\/p>\n<p>      Having heard learned Counsel for the parties, this writ petition<br \/>\nis disposed of finally with a direction to the opposite parties to issue<br \/>\ncharge sheet to the petitioner within six weeks. Reply to the charge<br \/>\nsheet will be submitted by the petitioner within 15 days from the<br \/>\ndate of receipt of charge-sheet. The Inquiry Officer shall concluded<br \/>\nthe enquiry within three months provided the petitioner co-operates<br \/>\nin the enquiry. The period, in which petitioner deliberately fails to<br \/>\ncooperate in the enquiry, will be excluded from the period of three<br \/>\nmonths. The Disciplinary Authority shall pass final orders after<br \/>\n<span class=\"hidden_text\">                                                                       2<\/span><\/p>\n<p>following due procedure of law within a month from the date of<br \/>\nreceipt of Enquiry Report. In any case the enquiry proceedings shall<br \/>\nbe concluded by 15th August, 2010. The petitioner shall retain the<br \/>\nhouse till 31st August, 2010. It is also provided that subsistence<br \/>\nallowance, if has not been paid to the petitioner regularly, same shall<br \/>\nbe paid without any further loss of time, in accordance wit rules.\n<\/p>\n<p>       With the aforesaid observations and directions this writ<br \/>\npetition is disposed of finally.
