Thereafter, the appeal was filed before the District and<br \/>\nSessions Court being Criminal Appeal No.37 of 2005 challenging the<br \/>\nsaid order of the District Magistrate.\n<\/p>\n<p>4.\t\tLearned<br \/>\nadvocate for the petitioners invited attention of the Court to the<br \/>\nlicence issued by the District Magistrate which is produced along<br \/>\nwith the petition at page 32 &#8211; Annexure-E to the petition.  The<br \/>\ndate of issuance of this licence is 22.12.2005.  Thus, it appears<br \/>\nthat before the order passed by the District Magistrate on<br \/>\n23.12.2005, the licence was issued on 22.12.2005.  It also appears<br \/>\nthat the show cause notice was issued on 21.12.2005 and the hearing<br \/>\nwas fixed on 22.12.2005 and on the very next date i.e. on 23.12.2005<br \/>\nthe order was passed by the District Magistrate.  It also appears<br \/>\nthat the Government vide its communication dated 14.11.2005 issued by<br \/>\nthe Civil Supplies Department indicates that the licence is to be<br \/>\ncollected on or before 31.12.2005.  It also appears that the<br \/>\npetitioners have applied for licence on 16.1.2002, but the said<br \/>\napplication was misplaced and, therefore, fresh application was made<br \/>\nby the petitioners on 20.10.2005.  In response to the said<br \/>\napplication and also in response to various reminders sent by the<br \/>\npetitioners, the licence was issued by the District Magistrate on<br \/>\n22.12.2005.\n<\/p>\n<p>5.\t\tOn<br \/>\nperusal of the orders passed by the District Magistrate, Bharuch as<br \/>\nwell as learned Additional Sessions Judge, Fast Track Court, Bharuch<br \/>\ncamp at Ankleshwar, it appears that the decision was taken keeping in<br \/>\nmind the fact that the petitioners were not possessing \/ holding<br \/>\nvalid licence.  The petitioners have produced the licence issued by<br \/>\nthe District Magistrate at Annexure-E page 32 of the petition for the<br \/>\nfirst time before this Court.\n<\/p>\n<p>6.\t\tConsidering<br \/>\nthe aforesaid factual matrix of the present case, the matter is<br \/>\nrequired to be remanded to the District Magistrate, Bharuch so as to<br \/>\nenable him to decide the case against the petitioners denovo<br \/>\nafter perusal of the licence which is produced along<br \/>\nwith the petition at Annexure-E  page 32 of the petition.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, this petition succeeds and the same is allowed. The order<br \/>\npassed by learned Additional Sessions Judge, Fast Track Court,<br \/>\nBharuch camp at Ankleshwar in Criminal Appeal No.37 of 2005 dated<br \/>\n29.4.2006 as well as the order dated 23.12.2005 passed by the<br \/>\nDistrict Magistrate, Bharuch in Case No.89 of 2005 are quashed and<br \/>\nset aside. The matter is remanded to the District Magistrate, Bharuch<br \/>\nso as to enable him to decide the case against the petitioners denovo<br \/>\nafter perusal of the licence which is produced along with the<br \/>\npetition at Annexure-E  page 32 of the petition. The petitioners are<br \/>\ndirected to produce a copy of the licence before the District<br \/>\nMagistrate, Bharuch for his perusal.
