Justice R.BASANT\n\n Dated :05\/10\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                       Crl.M.C.No.3068 of 2007\n                        -------------------------------------\n               Dated this the 5th day of October, 2007\n\n                                  O R D E R\n<\/pre>\n<p>      The petitioner, a woman, a member of the noble profession of<\/p>\n<p>law, faces indictment in a prosecution under Section 138 of the<\/p>\n<p>Negotiable Instruments Act.            Cognizance has been taken.    The<\/p>\n<p>petitioner has not entered appearance before the learned Magistrate.<\/p>\n<p>Consequently coercive processes have been issued against the<\/p>\n<p>petitioner by the learned Magistrate. The petitioner finds a warrant<\/p>\n<p>of arrest issued by the learned Magistrate chasing her.<\/p>\n<p>      2.    According to the petitioner, she is innocent. Her absence<\/p>\n<p>earlier was not wilful. She is willing to settle the disputes and ensure<\/p>\n<p>that the complainant compounds the offence alleged against her.<\/p>\n<p>Three weeks&#8217; time is required to settle the disputes and report<\/p>\n<p>composition. In these circumstances, it is prayed that the warrant of<\/p>\n<p>arrest issued by the learned Magistrate against the petitioner may be<\/p>\n<p>kept suspended and the petitioner may be given opportunity to appear<\/p>\n<p>before the Magistrate and seek regular bail within such stipulated time.<\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which she could not earlier appear before the learned<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3068 of 2007             2<\/span><\/p>\n<p>Magistrate. I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p>and expeditiously.   Every court must do the same.        No special or<\/p>\n<p>specific direction appears to be necessary.          Sufficient general<\/p>\n<p>directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      4.    This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioner appears before the<\/p>\n<p>learned Magistrate and applies for bail after giving sufficient prior<\/p>\n<p>notice to the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and expeditiously &#8211;<\/p>\n<p>on the date of surrender itself.\n<\/p>\n<p>      5.    In the peculiar facts and circumstances of the case, I<\/p>\n<p>direct that the warrant of arrest issued against the petitioner shall not<\/p>\n<p>be executed till 19.10.07.    The petitioner shall, in the meantime,<\/p>\n<p>appear before the learned Magistrate and seek bail.
