The petitioner is the<\/p>\n<p>husband of the de facto complainant. Marriage took place on<\/p>\n<p>02\/04\/2000. Spouses are blessed with a child, aged six years<\/p>\n<p>now. Crime has been registered. Investigation is in progress.<\/p>\n<p>The petitioner apprehends imminent arrest.<\/p>\n<p>     2.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent.              There is strain in the<\/p>\n<p>matrimonial relationship.         The wife is hence making wild,<\/p>\n<p>reckless and exaggerated allegations against the petitioner. The<\/p>\n<p>fact that she makes allegations of sexual perversity during<\/p>\n<p>pregnancy at this point of time when the child is aged six years,<\/p>\n<p>must itself reveal to this court the want of bona fides, submits<\/p>\n<p>the learned counsel for the petitioner.\n<\/p>\n<p>     3.   The learned Public Prosecutor does not oppose the<\/p>\n<p>said prayer.   The learned Public Prosecutor only prays that<\/p>\n<p>appropriate and strict conditions may be imposed in the interests<\/p>\n<p><span class=\"hidden_text\">B.A.No.5046\/07                  2<\/span><\/p>\n<p>of a fair and expeditious investigation.     I am satisfied that<\/p>\n<p>anticipatory bail can be granted to the petitioner. In coming to<\/p>\n<p>this conclusion, I have taken note of all the circumstances<\/p>\n<p>including the reality that arrest and incarceration of the<\/p>\n<p>petitioner in custody is likely to mar all possibilities of<\/p>\n<p>reconciliation and settlement of the matrimonial dispute.<\/p>\n<p>Appropriate conditions can, of course, be imposed.<\/p>\n<p>      4.    In the result, this petition is allowed.   Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      i)    Petitioner  shall  surrender   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 30\/8\/2007.<\/p>\n<p>      ii)   He shall be released on regular bail on condition that<\/p>\n<p>he executes a bond for Rs.25,000\/-(Rupees twenty five thousand<\/p>\n<p>only) with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate.\n<\/p>\n<p>      iii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 31\/08\/2007 and 01\/09\/2007 and thereafter on all<\/p>\n<p>Mondays and Fridays between 10 a.m and 12 noon for a period<\/p>\n<p><span class=\"hidden_text\">B.A.No.5046\/07                   3<\/span><\/p>\n<p>of two months and subsequently as and when directed by the<\/p>\n<p>investigating officer in writing to do so.\n<\/p>\n<p>      (iv) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with him in accordance with law,<\/p>\n<p>as if these directions were not issued at all.<\/p>\n<p>      (v)   If he were arrested prior to 30\/08\/2007, he shall be<\/p>\n<p>released from custody on his executing a bond for Rs.25,000\/-<\/p>\n<p>(Rupees twenty five thousand only) without any sureties,<\/p>\n<p>undertaking to appear before the learned Magistrate on<\/p>\n<p>30\/08\/2007.<\/p>\n<pre>\n\n\n\n                                             (R.BASANT, JUDGE)\njsr\n\n                 \/\/ True Copy\/\/      PA to Judge\n\n<span class=\"hidden_text\">B.A.No.5046\/07    4<\/span>\n\n<span class=\"hidden_text\">B.A.No.5046\/07    5<\/span>\n\n       R.BASANT, J.\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n            ORDER\n\n\n\n\n21ST DAY OF MAY2007\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sunu vs State Of Kerala on 20 August, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 5047 of 2007() 1.
