DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/07\/201 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that investigation<br \/>\n\tis over and charge sheet is filed.  It is further submitted<br \/>\n\tthat from the statements of [i] Abdul Sulemanbhai<br \/>\n\tKathuria, [ii] Kesubhai Sulemanbhai Kathuria and [iii] Ranabhai<br \/>\n\tKarsanbhai and cross complaint filed, it reveals that  father of the<br \/>\n\tapplicant received knife injury and was treated as indoor patient<br \/>\n\tfor few days.  It is further submitted that in the backdrop of the<br \/>\n\tallegations levelled in the FIR, ingredients of offences under<br \/>\n\tsection 302 of the IPC are not made out.  It is submitted that<br \/>\n\tconsidering the nature of allegations and role attributed to the<br \/>\n\tapplicant, by imposing suitable conditions,  the applicant may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts that charge<br \/>\n\tsheet is filed, father of the applicant received knife injury<br \/>\n\tand was treated as indoor patient for few days, prima facie it<br \/>\n\tappears that ingredients of offences under section 302 of the IPC<br \/>\n\tare not made out at this stage.  Therefore, without discussing the<br \/>\n\tevidence in detail, at this stage, I am inclined to enlarge the<br \/>\n\tapplicant on bail  in connection with .R.No.I-34\/2010 of Kalyanpur<br \/>\n\tPolice Station, Dist. Jamnagar for the offences punishable under<br \/>\n\tsections 302, 147, 148 of the Indian Penal Code, on furnishing<br \/>\n\tbond of Rs.10,000\/- (Rupees ten thousand only) with one surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and on<br \/>\n\tconditions that the applicant shall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe address of residence at the time of execution of the \tbond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately;\n<\/p>\n<p>[h]\tshall<br \/>\nnot enter into city and district limits of Jamnagar for 3 months or<br \/>\ntill commencement of trial, whichever is earlier, except for marking<br \/>\npresence.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
