           Petitioners are the plaintiffs in O.S No.1701 of<\/p>\n
2007 on the file of the Principal Munsiff Court, Irinjalakkuda.<\/p>\n
Suit is for declaration, fixation of boundary and injunction,<\/p>\n
both prohibitory and mandatory. Suit was laid to restrain<\/p>\n
the defendant from encroaching upon ‘B’ schedule property<\/p>\n
which is stated to be a road vested with the panchayat. ‘A’<\/p>\n
schedule is described as the property belonging to the<\/p>\n
defendant. As social workers, the plaintiff and others have<\/p>\n
planted some saplings beside the ‘B’ schedule panchayat<\/p>\n
road over which, according to the plaintiffs, the defendants<\/p>\n
have absolutely no right. Apprehending threat of trespass<\/p>\n
over ‘B’ schedule road, plaintiffs, two in number, petitioners<\/p>\n
herein, moved the above suit for injunction. The defendants<\/p>\n
resisted the suit claim by filing a written statement.<\/p>\n
Petitioners\/plaintiffs moved an application for appointment<\/p>\n
of an advocate commissioner to identify the ‘B’ schedule<\/p>\n
pathway after fixing the southern boundary of ‘A’ schedule<\/p>\n

property belonging to the defendant with the assistance of<\/p>\n
a surveyor, which was objected to by the defendants. After<\/p>\n
hearing both sides, the court below dismissed that<\/p>\n
application vide Ext.P4 order holding that necessary<\/p>\n
particulars for identification of the ‘B’ schedule pathway are<\/p>\n
not spelt out in the description of that property in the plaint.<\/p>\n
Impeaching the propriety and correctness of Ext.P4 order,<\/p>\n
the writ petition is filed invoking the supervisory jurisdiction<\/p>\n
vested with this court under Article 227 of the Constitution<\/p>\n
of India.\n<\/p>\n
            2. I heard the counsel on both sides. From the<\/p>\n
submissions made and perusing the ‘B’ schedule description<\/p>\n
it appears that necessary particulars are not made out in the<\/p>\n
plaint for a proper identification of ‘B’ schedule and also in<\/p>\n
fixing the southern boundary of ‘A’ schedule property.<\/p>\n
Ext.P4 also reveal that another suit filed by the defendants<\/p>\n
as O.S No.268\/2006 wherein the panchayat is made a<\/p>\n
defendant in which identical questions arise for adjudication<\/p>\n
is pending before the court. Panchayat has not been made a<\/p>\n
party in the present suit by the petitioners\/plaintiffs is<\/p>\n

another reason which prompted the court to dismiss the<\/p>\n
commission application. Considering the submissions made<\/p>\n
and the facts and circumstances presented, it appears that a<\/p>\n
joint trial of both the suits may be feasible. But I leave it to<\/p>\n
the court below to consider, after going through the<\/p>\n
pleadings in both the cases, whether such trial is essential,<\/p>\n
and needless to point out any decision for having a joint trial<\/p>\n
shall be ordered only after hearing the parties in both suits.<\/p>\n
Learned counsel appearing on both sides submit that joint<\/p>\n
trial of the two suits is feasible and more practicable. In case<\/p>\n
a joint trial of the two suits is ordered, the plaintiffs in the<\/p>\n
present case may move for a fresh commission for<\/p>\n
determination of the southern boundary of the ‘A’ schedule<\/p>\n
with ‘B’ schedule pathway. Ext.P4 order passed by the court<\/p>\n
will not stand in the way of the court if any such commission<\/p>\n
application is moved by the plaintiffs again and its disposal<\/p>\n
in accordance with law. Subject to the above observations,<\/p>\n
the writ petition is closed.<\/p>\n
