Whether the judgment should be reported in the\n               Digest ?\n            **\n\nNIRMALJIT KAUR, J.\n<\/pre>\n<p>            This is an appeal filed against the impugned Order dated<\/p>\n<p>29-07-2009 passed by the Election Tribunal under Punjab State Election<\/p>\n<p>Commission Act, 1994, vide which, the election petition filed by respondent<\/p>\n<p>No.1 was accepted and the election of the present appellant was set aside.<\/p>\n<p>            The facts, in short, are that the respondent and the appellant<\/p>\n<p>contested elections on 26-05-2008 for the post of Panch           (General<\/p>\n<p>Category) from Gram Panchayat, Village Channo. The respondent, herein,<\/p>\n<p>polled 118 votes and the present appellant was polled only 37 votes. The<br \/>\n<span class=\"hidden_text\"> F.A.O No.4806 of 2009                                               2<\/span><\/p>\n<p>present appellant was, thereafter, wrongly declared elected. Jaswinder<\/p>\n<p>Kaur challenged the said election.\n<\/p>\n<p>            Learned counsel for the appellant does not dispute that<\/p>\n<p>respondent No.1-Jaswinder Kaur was polled 118 votes while the appellant<\/p>\n<p>was polled only 37 votes. The only ground on which the order setting aside<\/p>\n<p>the election of appellant has been challenged is that the respondent-<\/p>\n<p>Jaswinder Kaur, did not comply with Section 77 of the Punjab State<\/p>\n<p>Election Commission Act, 1994 (here-in-after referred to as `the Act&#8217;) and<\/p>\n<p>did not implead all the contesting candidates, which was mandatory as per<\/p>\n<p>Section 77 of the Act. It was further argued that the nomination papers of<\/p>\n<p>Jaswinder Kaur, was filed for the post of Panch General Category<\/p>\n<p>(Woman), therefore, she could not have been declared elected against the<\/p>\n<p>post of Panch General Category.\n<\/p>\n<p>            Learned counsel for the appellant has been heard.\n<\/p>\n<p>            Learned counsel for the appellant does not dispute that there<\/p>\n<p>was no other candidate who had more votes than the appellant except<\/p>\n<p>respondent No.1. In view of this admitted position, the only affected person<\/p>\n<p>is the appellant, who was duly impleaded as party. Learned counsel for the<\/p>\n<p>appellant has not brought to the notice any case law suggesting that<\/p>\n<p>Section 77 of the Act is mandatory, even when no relief is sought against<\/p>\n<p>the other candidates and are not affected as in the facts of the present<\/p>\n<p>case.\n<\/p>\n<p>            The second argument of learned counsel for the appellant that<\/p>\n<p>Jaswinder Kaur having filed the nomination papers for the post of Panch<\/p>\n<p>General Category (Woman) could not have been declared elected against<\/p>\n<p>the post of Panch General Category, cannot be accepted, in view of the<\/p>\n<p>settled legal proposition of law. The Apex Court, in the judgment, rendered<\/p>\n<p>in the case of <a href=\"\/doc\/1296359\/\">Bihari Lal Rada v. Anil Jain (Tinu) &amp; Ors. JT<\/a> 2009(2) SC 455,<\/p>\n<p>is one such case. The respondent, therein, challenged the said election of<br \/>\n<span class=\"hidden_text\"> F.A.O No.4806 of 2009                                                   3<\/span><\/p>\n<p>the appellant mainly on the ground that as per the Notification issued by<\/p>\n<p>the Competent Authority, the office of the President of Municipal Council,<\/p>\n<p>Hisar, had been reserved for general category candidate and the same<\/p>\n<p>was to be filled in from amongst the members belonging to general<\/p>\n<p>category. Meaning thereby, for the office of the President of Municipal<\/p>\n<p>Council, Hisar only the members elected from the general category had a<\/p>\n<p>right and not the members elected from Backward Class category. In the<\/p>\n<p>facts of that case, it was held as follows :-\n<\/p>\n<blockquote><p>                       &#8221; There is nothing in the provisions of the<br \/>\n              Act, 1973 suggesting that in case the office of the<br \/>\n              President of a Municipality is required to be filled in<br \/>\n              from the members belonging to the general<br \/>\n              category then only a member who has been<br \/>\n              elected as such from an unreserved ward alone<br \/>\n              can stand for election. There is nothing in law that<br \/>\n              a person belonging to Backward Class and got<br \/>\n              himself elected from a ward reserved for that class<br \/>\n              is debarred from contesting the election to the<br \/>\n              office of President\/Chairperson when that office is<br \/>\n              not reserved and meant to be filled in from the<br \/>\n              members belonging to the general category.<\/p>\n<blockquote><p>                     33.    In our view, wherever the office of the<br \/>\n              President of a Municipality is required to be filled in<br \/>\n              by a member belonging to Scheduled Caste,<br \/>\n              Scheduled Tribe or Backward Class as the case<br \/>\n              may be, it would be enough if one belongs to one<br \/>\n              of those categories irrespective of the fact whether<br \/>\n              they have been elected from a general ward or a<br \/>\n              reserved ward. Likewise, the office of the President<br \/>\n              of a Municipality if not reserved or meant for<br \/>\n              general category, all the candidates irrespective of<br \/>\n              their caste, class or community and irrespective of<br \/>\n              the fact whether they have been elected from a<br \/>\n              reserved ward or a general ward are entitled to<br \/>\n              seek election and contest to the office of the<br \/>\n              President of the Municipality.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> F.A.O No.4806 of 2009                                                 4<\/span><\/p>\n<p>            Similar view has also been expressed by a Division Bench of<\/p>\n<p>this Court in the case of Sampuran Singh (supra). In that case, the<\/p>\n<p>controversy was, whether a Panch, who was elected as such against the<\/p>\n<p>seat reserved for General Category, is eligible to contest the election of the<\/p>\n<p>office of Sarpanch, which is reserved for the category of Scheduled Caste.<\/p>\n<p>The Division Bench, while relying upon the judgment of Hon&#8217;ble the Apex<\/p>\n<p>Court, mentioned above, held :-\n<\/p>\n<blockquote><p>                   &#8221; We are of the opinion that a Panch belonging to<br \/>\n               the Scheduled Caste is eligible to contest the election<br \/>\n               of the office of Sarpanch, which is reserved for<br \/>\n               Scheduled Caste by producing a Scheduled Caste<br \/>\n               Certificate. He cannot be prevented to contest the<br \/>\n               election only on the ground that he was elected as<br \/>\n               Panch against the seat reserved for General<br \/>\n               Category.\n<\/p><\/blockquote>\n<blockquote><p>                     6. A bare reading of Sub Section (1) of Section<br \/>\n               12 of the Panchayati Raj Act, 1984 makes it clear that<br \/>\n               the number of the offices of Sarpanch of the Gram<br \/>\n               Panchayat in the district shall be reserved for<br \/>\n               Scheduled Castes proportionately to the population of<br \/>\n               the Scheduled Castes in the District. This Section<br \/>\n               does not provide that only a Panch, who has been<br \/>\n               elected as such against the seat reserved for<br \/>\n               Scheduled Caste can only contest the election of the<br \/>\n               office of Sarpanch, which is reserved for the category<br \/>\n               of Scheduled Caste.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            Section 55 of the Act reads as under :-\n<\/p><\/blockquote>\n<blockquote><p>                      &#8220;55. Eligibility of members of Scheduled<br \/>\n                  Castes to hold seats not reserved for those<br \/>\n                  castes.- For the avoidance of doubt, it is hereby<br \/>\n                  declared that a member of the Scheduled Castes<br \/>\n                  shall not be disqualified to hold a seat not<br \/>\n                  reserved for members of those castes, if he is<br \/>\n                  otherwise qualified to hold such seat under the<br \/>\n                  Constitution of India and this Act.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<p><span class=\"hidden_text\"> F.A.O No.4806 of 2009                                                5<\/span><\/p>\n<blockquote><p>             On perusal of the above as well as taking into account the law,<\/p>\n<p>laid down by Hon&#8217;ble the Supreme Court, there is no bar on a candidate<\/p>\n<p>being a `woman from general category&#8217; to contest the election against the<\/p>\n<p>post of `general category&#8217;. There is nothing called reservation for General<\/p>\n<p>Category. Admittedly, it was a post of general category. No distinction as to<\/p>\n<p>whether it was for only male (general category) or female (general<\/p>\n<p>category) was provided. It is apparent that even a candidate belonging to<\/p>\n<p>any other reserved category as also a woman belonging to general<\/p>\n<p>category, if otherwise eligible cannot be disqualified against general<\/p>\n<p>category.
