JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 29\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to hold and declare that since the<br \/>\npetitioners have been selected against single post cadre,<br \/>\naccordingly, there cannot be any reservation on single cadre post as<br \/>\nthe Hon&#8217;ble Supreme Court has held in the case of P.G.Institute of<br \/>\nMedical Education and Research Vs. Faculty Association, reported in<br \/>\nAIR 1998 SC 1767 and also the Hon&#8217;ble Supreme Court has been pleased<br \/>\nto settle the principle of law that there cannot be any reservation<br \/>\nin respect of single post in the case of <a href=\"\/doc\/1661729\/\">State of Karnataka and<br \/>\nothers V. K.Govindappa and Anr.<\/a> reported in (2009)1 SCC p.1 and<br \/>\naccordingly, Your Lordships may be pleased to direct the respondent<br \/>\nauthorities to issue the orders of appointment in respect of single<br \/>\ncadre posts against which the petitioners have been declared to be<br \/>\nselected.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to direct the respondent authorities to<br \/>\nundertake the process of issuance of the orders of appointment in<br \/>\nfavour of the petitioners and complete the same without any more<br \/>\ndelay.\n<\/p>\n<p>(C)\tThis<br \/>\nHon&#8217;ble Court be pleased to pass such other and further order\/s as<br \/>\ndeemed fit, just and proper by this Hon&#8217;ble Court.&#8221;\n<\/p>\n<p>\tThe<br \/>\ncase of the petitioners is, that several single cadre posts were<br \/>\nadvertised vide Advertisement dated 28.07.2010 by Radhanpur<br \/>\nNagarpalika. The petitioners applied for the posts in question and<br \/>\nafter interviews, the petitioners were communicated that they have<br \/>\nbeen selected by the Selection Committee. According to the<br \/>\npetitioners, in view of the settled legal position, there could have<br \/>\nbeen no reservation in a single cadre posts.\n<\/p>\n<p>\tUpon<br \/>\nnotice being issued, the respondents have appeared and filed their<br \/>\naffidavits-in-reply. In the affidavit-in-reply filed by the State<br \/>\nGovernment, it has been categorically stated that in view of the<br \/>\ndecision of the Supreme Court in the case of P.G. Institute<br \/>\nof Medical Education and Research v. Faculty Association reported in<br \/>\nAIR 1998 SC 1767, there can be no reservation, until there is<br \/>\nplurality of posts in a cadre and that if there is one post within a<br \/>\ncadre, then the same cannot be set apart for a reserved category<br \/>\ncandidate. It is further stated that by Government Resolution dated<br \/>\n16.12.2004, issued by the General Administration Department, it has<br \/>\nbeen clarified that no reservation is to be provided where there is<br \/>\nonly one post in the cadre. It is further stated that the Government<br \/>\nhas sanctioned 113 posts on the establishment of Radhanpur<br \/>\nNagarpalika, some of which are single isolated posts within a cadre<br \/>\nand in respect of those posts, the policy of reservation, either<br \/>\ndirectly or by operation of device of rotation of Roster, will not be<br \/>\nmade applicable.\n<\/p>\n<p>\tIn<br \/>\nthe further affidavit filed by the Nagarpalika, the stand taken by<br \/>\nthe State Government has been reiterated by stating that there can be<br \/>\nno reservation until there is plurality of the post in a cadre and if<br \/>\nthere is a single post within a cadre, the same cannot be said to be<br \/>\na part of reservation.\n<\/p>\n<p>\tHeard<br \/>\nthe learned advocates for the respective parties and perused the<br \/>\ndocuments on record.\n<\/p>\n<p>\tIt<br \/>\nis clarified by Mr.Deepak Sanchela, learned advocate for respondents<br \/>\nNos.4 and 5, that in the Advertisement in question, single posts have<br \/>\nbeen advertised and no reservation has been provided. In view of the<br \/>\naffidavits-in-reply filed by the State Government and the respondent\n<\/p>\n<p>&#8211; Nagarpalika, no reservation shall be applied to single cadre<br \/>\nposts.\n<\/p>\n<p>\tMr.R.K.Mishra,<br \/>\nlearned advocate for the petitioners, states that in view of the<br \/>\naffidavits-in-reply filed by the State Government and the respondent\n<\/p>\n<p>&#8211; Nagarpalika, the grievances of the petitioners have been<br \/>\nredressed and nothing further remains to be adjudicated, and the<br \/>\nrespondent &#8211; Nagarpalika may be directed to issue appointment<br \/>\norders to the petitioners, and the petition may be disposed of as<br \/>\nhaving become infructuous.\n<\/p>\n<p>\tIn<br \/>\nview of the respective statements made by the learned advocates for<br \/>\nthe petitioners and respondent &#8211; Nagarpalika, and the<br \/>\naffidavits filed by them, the following order is passed:-\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of as having become infructuous, with the<br \/>\nstipulation that the respondent-authorities shall take consequential<br \/>\naction, strictly in accordance with law.\n<\/p>\n<p>\tIt<br \/>\nis made clear that while passing this order, the Court has not<br \/>\nentered into the merits of the case.\n<\/p>\n<p>\tNotice<br \/>\nis discharged.
