\t\tConsidering
\nthe facts and circumstances as the original respondent
\ndeceased,-Dhanjibhai Ambalal Patel has already expired and the death
\ncertificate is also produced and the cause has continued pending the
\nappeal, it would be just and proper to condone the delay caused in
\npreferring the application and to allow legal heirs of deceased to be
\njoined as the party.\n<\/p>\n
\t\tHence
\nthe applicants are permitted to be joined as the party in the First
\nAppeal No.2453 of 1995 being legal representatives
\nof deceased,-Dhanjibhai Ambalal Patel. Application allowed to the
\naforesaid extent. Rule made absolute.\n<\/p>\n
