Justice M.L.JOSEPH FRANCIS\n\n Dated :07\/06\/2010\n\n O R D E R\n          K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                W.P.(C) No.13789 of 2010-W\n           ----------------------------------------------\n             Dated, this the 7th day of June, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>              Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>     &#8220;1.    to issue a writ of mandamus or any other<\/p>\n<p>     appropriate    writ    order,    direction    commanding<\/p>\n<p>     respondent Nos.1 and 2 to give sufficient police<\/p>\n<p>     protection to the life of the petitioner as well as to the<\/p>\n<p>     Institution.\n<\/p><\/blockquote>\n<blockquote><p>     2. to issue a writ of mandamus directing respondents 1<\/p>\n<p>     and 2 to provide adequate and sufficient police<\/p>\n<p>     protection to the petitioner and his institution to run the<\/p>\n<p>     institution without any threat, intimidation or physical<\/p>\n<p>     obstruction being caused by respondents 3 to 6 or<\/p>\n<p>     anybody acting under them.\n<\/p><\/blockquote>\n<blockquote><p>     3. to declare that respondents 3 to 6 have no manner<\/p>\n<p>     of right or authority to cause obstruction to the<\/p>\n<p>     petitioner to conduct the institution.<\/p>\n<\/blockquote>\n<blockquote><p>            A declaration is also sought.<\/p><\/blockquote>\n<p>            2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows:   Petitioner is the Branch Manager of an institution<\/p>\n<p>owned by M\/s.Treasia Mathew. She is a non-resident and is<\/p>\n<p>now in Australia.      It is submitted that the institution of the<\/p>\n<p><span class=\"hidden_text\">WPC No.13789\/2010                               -2-<\/span><\/p>\n<p>petitioner is engaged in the business of service assistance for<\/p>\n<p>training at overseas which includes students visa, training,<\/p>\n<p>admission in professional institution, professional registration<\/p>\n<p>IELTS OET.      Respondents 3 and 5 got registered in the<\/p>\n<p>petitioner institution for overseas studies and student VISA.<\/p>\n<p>There is reference to Exts.P1 and P2 agreements.        It is the<\/p>\n<p>case of the petitioner that respondents could not arrange bank<\/p>\n<p>loan to meet their expenses for studies in Australia and<\/p>\n<p>respondents did not join within time.         There is further<\/p>\n<p>reference to threat and interference by the 4th, 5th and 6th<\/p>\n<p>respondents.     They demanded back the process fee. It is<\/p>\n<p>alleged that they also threatened the petitioner that they will<\/p>\n<p>do away the petitioner unless he pays compensation.<\/p>\n<p>Petitioner filed Exts.P3 and P4 complaints. A counter affidavit<\/p>\n<p>has been filed by respondents 5 and 6.\n<\/p>\n<p>             3. We are not going into the allegations made by<\/p>\n<p>the petitioner as against      the party respondents or the<\/p>\n<p>allegations in the counter affidavit.        Whatever be the<\/p>\n<p>complaints that the party respondents have against the<\/p>\n<p>petitioner they cannot physically obstruct or interfere with the<\/p>\n<p>working of the petitioner&#8217;s institution. In such circumstances,<\/p>\n<p><span class=\"hidden_text\">WPC No.13789\/2010                                -3-<\/span><\/p>\n<p>the writ petition is disposed of as follows:<\/p>\n<p>            There will be a direction to respondents 1 and 2 to<\/p>\n<p>give protection to the life of the petitioner for running his<\/p>\n<p>institution without any intimidation or physical obstruction by<\/p>\n<p>respondents 3 to 6.
