C.\n\nHon'ble Amreshwar Pratap Sahi,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and the learned standing<br \/>\ncounsel.\n<\/p>\n<p>Inspite of time having granted to the learned standing counsel no<br \/>\ncounter affidavit has been filed.\n<\/p>\n<p>This writ petition has been filed questioning the correctness of the order<br \/>\npassed by the Inspector General of Police, Allahabad Range, Allahabad<br \/>\nexercising his powers under Rule 8(2)(b) of the U.P.Police Officers of<br \/>\nSubordinate Ranks (Punishment and Appeal) Rules, 1991 dispensing<br \/>\nthe services of the petitioner on account of his involvement in the<br \/>\nincident as narrated in the order.\n<\/p>\n<p>The facts leading to passing of the order are that some information was<br \/>\nreceived by the police authorities that some persons are unauthorisedly<br \/>\nrealising money by way of extortion and an F.I.R. was lodged to that<br \/>\neffect. It is contended that the petitioner was also found involved along<br \/>\nwith his brother in the said incident. The criminal case is stated to be<br \/>\npending. In between an order has been passed on 9.4.2010 dismissing<br \/>\nthe petitioner from service.\n<\/p>\n<p>Learned counsel for the petitioner contends that the order of dismissal is<br \/>\nerroneous and not in accordance with law keeping in view the law laid<br \/>\ndown by the Division Bench of this Court in the case of Yadunath<br \/>\nSingh Vs. State of U.P. reported in 2009(9) ADJ 86.\n<\/p>\n<p>The submission is that the impugned order records a categorical finding<br \/>\nthat it is not reasonable to hold the inquiry as the conduct of the<br \/>\npetitioner amounts to lowering the prestige of the Police Department.<br \/>\nLearned counsel for the petitioner contends that in the absence of any<br \/>\nsatisfaction recorded for dispensing the enquiry, the impugned order is<br \/>\nvitiated as it does not satisfy the requirement of Rule 8(2)(b).<br \/>\n Learned standing counsel contends that the petitioner is involved in a<br \/>\ncriminal case and the nature of the incident was such fact it would be<br \/>\npractically impossible to obtain any evidence so as to hold a regular<br \/>\ninquiry under Rule 14(1) of the U.P.Police Officers of the Subordinate<br \/>\nRanks (Punishment and Appeal) Rules, 1991.\n<\/p>\n<p>Having considered the submissions advanced and having perused the<br \/>\nratio of the aforesaid decision I am of the view that the contention raised<br \/>\nby the learned standing counsel that it will not be possible to obtain any<br \/>\nevidence is a mere presumption and further the same cannot be a<br \/>\nreason to dispense with an inquiry. This submission of the learned<br \/>\nstanding counsel is even otherwise not borne out from reasons given in<br \/>\nthe impugned order which do not indicate or reflect the aforesaid<br \/>\nsubmission. In my opinion the reasons given in the impugned order are<br \/>\nin term of the ratio of the decision of the Division Bench judgment in the<br \/>\ncase of Yadunath (supra).\n<\/p>\n<p>The order dated 21.4.2010 being in breach of the aforesaid ratio of the<br \/>\ndecision of the Division Bench is set aside leaving it open to the<br \/>\nrespondent authorities to proceed against the petitioner in accordance<br \/>\nwith law keeping in view the fact that a criminal case is already lodged<br \/>\nagainst him.\n<\/p>\n<p>It is further made clear that this order will not entitle the petitioner to<br \/>\nclaim any automatic consideration for re-instatement and the<br \/>\nrespondent authorities if proceed to make an inquiry the same shall be<br \/>\nconcluded within three months.\n<\/p>\n<p>The writ petition accordingly stands disposed of.\n<\/p>\n<p>Order Date :- 16.7.2010<br \/>\nmna\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Shesh Mani Dubey vs State Of U.P.
