Wadhwa, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by the state of Orissa is directed against<br \/>\nthe judgement  of the  Orissa Administrative  Tribunal\t(for<br \/>\nshort the  Tribunal&#8217;) dated January 9,1995 allowing Original<br \/>\nApplication No.2056  of 1994  of the respondent holding that<br \/>\nthe respondent,\t would retire  at the age of 60 years as per<br \/>\nthe service rule applicable in the State.\n<\/p>\n<p>     The  respondent  jointed  service\tin  the\t workcharged<br \/>\nestablishment  of   the\t Executive   Engineer,\t Roads\t and<br \/>\nBuildings, Bhubaneswar\ton November  16,1961 as a mason.  On<br \/>\nFebruary  17,1978   he\twas  brought  over  to\tthe  regular<br \/>\nestablishment thus  being in the Government Department.\t The<br \/>\nrespondent was\tto retire  on September 30,1994 on attaining<br \/>\nthe age\t of  58\t years.\t   The\trespondent,  however,  filed<br \/>\noriginal application  in the  Tribunal claiming\t that he was<br \/>\nentitled to  continue in  service upto\tthe age of 60 years.<br \/>\nHis claim  was based  on the &#8216;Note &#8216; below second proviso to<br \/>\nRule 71(a)  of the  Orissa Service  Code.  His further claim<br \/>\nwas that the Works Department of the State Government should<br \/>\nbe treated  as &#8220;industry&#8217;  relying upon\t a decision  of\t the<br \/>\nSupreme Court in the case of <a href=\"\/doc\/1822144\/\">Des Raj and others vs. State of<br \/>\nPunjab and others<\/a> 1988 (2) SLR 789.\n<\/p>\n<p>     The Tribunal  noticed that the State Government did not<br \/>\nfile any  counter and  that note  on  which  the  respondent<br \/>\nrelied\twas   incorporated   as\t  per\tFinance\t  Department<br \/>\nnotification dated October 13,1989 which reads as follows:\n<\/p>\n<blockquote><p>     &#8220;Workman&#8221; means  a highly\tskilled,<br \/>\n     skilled, semi-skilled  or unskilled<br \/>\n     artisan employed  on a monthly rate<br \/>\n     of\t pay   in  any\t industrial   or<br \/>\n     workcharged establishment.&#8221;<\/p><\/blockquote>\n<p>     The Ribunal then held that an artisan was a functionary<br \/>\nwhose nature  of work  was manual  and that mason would come<br \/>\nwithin that  category.\t It also  noticed that\tin a certain<br \/>\ncommunication of  the Works  Department a  post of the mason<br \/>\nwas catagorised as &#8220;workman&#8221;.  The Tribunal then referred to<br \/>\nvarious\t others\t  OAS  filed   by  employees  of  the  Works<br \/>\nDepartment  was\t an  industry.\t  The  Tribunal,  therefore,<br \/>\nconcluded that\tthe respondent\twas to be treated as workman<br \/>\nand he\twas entitled to continue in service till he attained<br \/>\nthe age\t of 60\tyears.\t The State Government filed a review<br \/>\napplication before  the Tribunal  bringing to  its notice  a<br \/>\njudgement of  this Court  in State  of Orissa and others Vs.<br \/>\nAdwait Charan  Mohanty and  others Civil  Appeal No.1497  of<br \/>\n1993 decided  on January  27, 1995  (since reported  as 1995<br \/>\nSupp (1)  SCC 470)  pointing out  that in a similar case the<br \/>\nSupreme Court  had held\t that a government employee like the<br \/>\nrespondent would  retire at  the age  of  58  years.\tThis<br \/>\napplication was\t dismissed by  the Tribunal  on July  8,1996<br \/>\nwithout referring  to the judgement of this Court and merely<br \/>\nnoting that  the State Government only wanted to record that<br \/>\ncounter affidavit  had been  filed which  according  to\t the<br \/>\nTribunal was  filed one\t day late after it had announced the<br \/>\njudgement.\n<\/p>\n<p>     It was  submitted before  us that\tthe present case was<br \/>\nfully covered  by the  aforesaid decision in Adwait Mhanty&#8217;s<br \/>\ncase.\tPrior to  the amendment of the note below the second<br \/>\nproviso to  Rule 71(a)\twhich has been reproduced above, the<br \/>\nnote reads as under:\n<\/p>\n<blockquote><p>     &#8220;Note:- For  this\tpurpose\t workman<br \/>\n     means  a\thighly\tskilled,   semi-<br \/>\n     skilled  and   un-skilled\t artisan<br \/>\n     employed on  a monthly  rate of pay<br \/>\n     in any govt. establishment.&#8221;<\/p><\/blockquote>\n<p>     It\t is   significant  to\tnote  that  the\t &#8220;Government<br \/>\nestablishment&#8221; has  been omitted after amendment of the Note<br \/>\nand the\t Note as  it existed  now would\t apply industrial or<br \/>\nworkcharged establishment and not those employees working in<br \/>\nany Government establishment.  Admittedly, the respondent is<br \/>\nworking in  the Government  establishment and  the  Note  on<br \/>\nwhich the Tribunal relied would be inapplicable to his case.<br \/>\nThis very  note was  subject matter of interpretation in the<br \/>\ncase of\t Adwait Mohanty\t where also  the question  was if an<br \/>\nartisan in  the Government establishment would retire at the<br \/>\nage of\t58 years  or on\t his attaining the age of 6 0 years.<br \/>\nThis Court  after considering the relevant rules came to the<br \/>\nconclusion that\t an artisan  in the  circumstances  being  a<br \/>\nGovernment employee  would retire  on his  completion of  58<br \/>\nyears of  age.\t Statement of  law by this Court in the case<br \/>\nAdwait Mohanty\tfully covers  the facts of this case and the<br \/>\nrelevant rules on the subject.\n<\/p>\n<p>     Accordingly,  the\t appeal\t is  allowed,  the  impugned<br \/>\njudgement of  the Tribunal  is set aside and the OA filed by<br \/>\nthe respondent\tis dismissed.\tThere will be no order as to<br \/>\ncosts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Orissa &amp; Ors vs Sadhu Charan Pradhan on 17 September, 1997 Author: D Wadhwa Bench: Sujata V.
