Justice V.GIRI\n\n Dated :25\/01\/2008\n\n O R D E R\n                                     V.GIRI,J.\n\n                             -------------------------\n\n                       W.P ( C) No.   280   of 2008\n\n                             --------------------------\n\n                  Dated this the 25th  January, 2008\n\n\n                               J U D G M E N T\n<\/pre>\n<p>       The   petitioner   while   serving   as   a   Superintendent   in   the<\/p>\n<p>Kochi Corporation was suspended from service as per Exhibit P2<\/p>\n<p>order.  He moved the authorities against the order of suspension<\/p>\n<p>seeking revocation of the same.   Suspension was revoked under<\/p>\n<p>Exhibit   P3   order     but   subject   to   the   rider   of   that     he   may   be<\/p>\n<p>posted in any of the Municipalities except  in Pathanamthitta and<\/p>\n<p>Ernakulam   Districts.     Petitioner   sought   for   variation   of   Exhibit<\/p>\n<p>P3 vide Exhibit P4 which was rejected under   Exhibit  P5 order,<\/p>\n<p>The same is under challenge in this writ petition.\n<\/p>\n<p>       2.     Petitioner cannot be aggrieved by Exhibit P3 order as<\/p>\n<p>such.   The   allegations     forming   the   subject   matter   of   enquiry,<\/p>\n<p>pending which the petitioner has been placed under suspension<\/p>\n<p>is   relatable   to   the   petitioner&#8217;s   tenure   in   the   Thiruvalla<\/p>\n<p>Municpality.     The   restriction   on   posting   the   petitioner   in<\/p>\n<p>Pathanamthitta District cannot be faulted with.  But it is difficult<\/p>\n<p>to   understand   why   the   restriction   should   be   extended   to   the<\/p>\n<p>W.P ( C) No.   280   of 2008<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>Municipalities in Ernakulam district also.     I do not express any<\/p>\n<p>final opinion on this aspect.\n<\/p>\n<p>       3.     Learned   Government   Pleader   submits   that   petitioner<\/p>\n<p>cannot insist   on a particular place  of  posting, on  revocation  of<\/p>\n<p>suspension.   This   is   correct.     But   restriction   imposed   must   be<\/p>\n<p>independently justified.\n<\/p>\n<p>       In the result, this writ petition is disposed of permitting the<\/p>\n<p>petitioner   to   move   for   a   change   in   Exhibit   P3   in   so   far   as   it<\/p>\n<p>relates to the restriction on the petitioner being posted in any of<\/p>\n<p>the Municipalities in Ernakulam district.  If the petitioner moves<\/p>\n<p>for variation of Exhibit P3, within  one month from today,  it shall<\/p>\n<p>be   looked   into   by   the   Government   and   appropriate     decision<\/p>\n<p>taken in accordance with law, after hearing the petitioner, within<\/p>\n<p>three   months   thereafter.              Such   decision   shall   be   taken<\/p>\n<p>untrammeled   by   Exhibit   P5.
