\n                            There is a history behind the challenge to the
\n3   19\/08\/2010
\n                    order dated 1.11.2003 which has been annexed as<\/p>\n
                    annexure-10 to the writ application. Petitioner is sought<\/p>\n
                    to be punished for the crime which he never committed<\/p>\n
                    and that too without there        being any finding by the<\/p>\n
                    enquiry officer that the charges which were drawn up<\/p>\n
                    against him are established.\n<\/p>\n
                            Short history behind the present writ application<\/p>\n
                    is that the petitioner vide order dated 5.9.1995 issued by
\n                   -2-<\/span><\/p>\n
the police headquarters was ordered to be transferred<\/p>\n
from Gaya police force to the C.I.D. at Patna. Petitioner<\/p>\n
came and joined on 27.10.995 but since one of the person<\/p>\n
who formed part of the chain of transfer was not relieved<\/p>\n
since his order of transfer came to be stayed, there was<\/p>\n
no vacancy in the C.I.D. Department for the petitioner to<\/p>\n
continue. By an order of the C.I.D. department issued on<\/p>\n
6.11.1995 petitioner was sent back to Gaya. There were<\/p>\n
other orders of transfer in between too but none of them<\/p>\n
came to be effected for one reason or the other including<\/p>\n
the code of conduct being in force due to some election<\/p>\n
or the other going on in the State of Bihar. Petitioner<\/p>\n
continued to work with Gaya police till all of a sudden<\/p>\n
vide order dated 23.5.1997 issued by the Headquarters,<\/p>\n
he came to be suspended for not obeying the order of<\/p>\n
transfer issued in the year 1995.\n<\/p>\n
        It took two years for the Police Headquarters to<\/p>\n
realize that the petitioner has not obeyed the order of<\/p>\n
transfer. A deeper look would show that that was not the<\/p>\n
actual state of affair because petitioner did report to the<\/p>\n
C.I.D. department but was sent back in the circumstances<\/p>\n
noted above.\n<\/p>\n

        Petitioner remained under suspension between<\/p>\n
28.6.1997 and 7.9.1998. During this period, it is said<\/p>\n
that his Headquarter was fixed at the C.I.D. Headquarters<\/p>\n
at Patna and even a departmental enquiry was conducted<\/p>\n
in which the enquiry officer did not find him guilty.<\/p>\n
        In view of various orders which came to be<\/p>\n
passed at various levels and the manner in which the<\/p>\n
petitioner was sent back to the district of Gaya from<\/p>\n
where he was transferred, it was more a comedy of errors<\/p>\n
rather than a case of defiance by a subordinate to the<\/p>\n
orders of the Superiors.        In this background the<\/p>\n
suspension order came to be revoked but the problem of<\/p>\n
the petitioner did not come to an end. Now a new kind<\/p>\n
of charge was held out against him that during the period<\/p>\n
of suspension he did not remain in the Headquarter and,<\/p>\n
therefore, the authorities decided to apply the principle of<\/p>\n
‘no work and no pay’ for the period of suspension.<\/p>\n
Petitioner filed a review and appeal. The matter was<\/p>\n
diluted by the authorities who modified the order to the<\/p>\n
extent that this period will be adjusted against his earned<\/p>\n
leave. The net effect is that the petitioner does not have<\/p>\n
required earned leave for the period of suspension and he
\n                   -4-<\/span><\/p>\n
will go without salary for no fault of his.<\/p>\n
        Stand of the respondents is that since the<\/p>\n
petitioner did not mark his attendance every day during<\/p>\n
the period of suspension, that period will have to be<\/p>\n
treated as no work and no salary can be paid to him. But<\/p>\n
the principle of ‘no work and no pay’ will come to apply<\/p>\n
provided it was a voluntary act of the petitioner not to<\/p>\n
work. A suspended employee is not expected to work<\/p>\n
otherwise he cannot be treated to be a suspended<\/p>\n
employee. No doubt, Headquarter is fixed during the<\/p>\n
period of suspension but the Court has not been pointed<\/p>\n
out any service condition, rule or authority which could<\/p>\n
show that the petitioner was expected to perform any<\/p>\n
kind of responsibility besides hanging out at the<\/p>\n
headquarters during the period of suspension.<\/p>\n
        Fate of the petitioner came to be decided by the<\/p>\n
Police headquarters because there is lack of coordination<\/p>\n
amongst the authorities.     If the department of C.I.D.<\/p>\n
passed an order dated 6.11.1995 and directed the<\/p>\n
petitioner to report back to Gaya district Police which<\/p>\n
order the petitioner carried out, there was no occasion to<\/p>\n
suspend the petitioner for not following the order of
\n                           -5-<\/span><\/p>\n
        initial transfer dated 5.9.1995. All these aspects have<\/p>\n
        been taken note of by the enquiry officer but then the<\/p>\n
        superiors have failed to look into all these details and the<\/p>\n
        niceties more so since the petitioner is a small employee,<\/p>\n
        down ladder who is on the receiving end. There cannot<\/p>\n
        be a better case of arbitrary exercise of power than what<\/p>\n
        has been taken note of in the earlier part of the order.<\/p>\n
                Annexure-1 stands quashed.          The respondent<\/p>\n
        authorities are directed to pay salary of the petitioner for<\/p>\n
        the period 28.6.1997 to 7.9.1998 which was ordered to be<\/p>\n
        withheld and adjusted against the earned leave.<\/p>\n
        Withholding of salary or even subsequent modification<\/p>\n
        of the order by adjusting the said period against earned<\/p>\n
        leave would amount to punishing the petitioner for a<\/p>\n
        charge which was not proved or established.<\/p>\n
                This writ application is allowed.         Since the<\/p>\n
        petitioner has already superannuated, the Court expects<\/p>\n
        the benefit to accrue to the petitioner within a period of<\/p>\n
        three   months    from    the   date   of   production     or<\/p>\n
        communication of a copy of this order.\n<\/p>\n<\/p>\n
