Bhaya appearing on behalf of appellant<br \/>\nNew India Assurance Company Limited.\n<\/p>\n<p>\tIn<br \/>\nboth appeals, appellant insurance company has challenged interim<br \/>\norders passed by MACT, Junagadh in Claim Case No.47 of 2006 being an<br \/>\nInterim Relief Application No.27 of 2006 Ex.6 dated 3rd<br \/>\nAugust 2009 and in Claim Case No.48 of 2006 Ex.6 being an Interim<br \/>\nRelief Application No.28 of 2006 decided on 3rd August<br \/>\n2009. In both interim orders, Claims Tribunal, Junagadh has awarded<br \/>\nRs.25,000\/- with 9% interest in favour of respondents claimants.\n<\/p>\n<p>\tThe<br \/>\nclaim petitions filed by claimants were arising from one accident<br \/>\noccurred on 22nd June 2005 at about 10-00 am between<br \/>\nSatadhar to Visavadar road.  The FIR was lodged being CR-I No.71 of<br \/>\n2005 before Visavadar Taluka Police Station.\n<\/p>\n<p>\tThe<br \/>\nclaimants were travelling in Rickshaw No.GJ-11-W-7290 with their<br \/>\ngoods towards village Visavadar. At that time, Opponent No.1 driven<br \/>\nthe said rickshaw in rash and negligent manner and due to that, it<br \/>\nhad turned turtle causing serious injuries to applicants claimants on<br \/>\nvarious parts of body which has resulted into disablement to them,<br \/>\ntherefore, 166 application is filed by both claimants against<br \/>\nopponents. The appellant insurance company has filed its composite<br \/>\nreply before claims tribunal against main claim petition as well as<br \/>\ninterim application, wherein, it is denied the factum of accidentand<br \/>\nresultant disability to claimants and their liability to pay the<br \/>\ncompensation. The appellant insurance company mainly contended that<br \/>\nopponent No.1 who was driving the rickshaw in question was not<br \/>\nholding legal and valid driving licence at the time of accident and<br \/>\ntherefore, there being a breach of terms and conditions of insurance<br \/>\npolicy, therefore, they are not liable to answer the claim. It is<br \/>\nalso alleged that claimants were travelling in said vehicle without<br \/>\nany goods and therefore, being a gratuitous passengers, claimants are<br \/>\nnot entitled to get any compensation from them. Before claims<br \/>\ntribunal, claimant has produced documentary evidence which consists;<br \/>\ncopy of FIR, Panchnama of scene of occurrence, Form No.54, RC Book of<br \/>\nvehicle, first page of charge-sheet, driving licence, insurance<br \/>\npolicy, MLC certificate, police statement, disability certificate.<br \/>\nCopy of insurance policy has also been produced by opponent No.3<br \/>\nappellant insurance company before claims tribunal. Thereafter,<br \/>\nclaims tribunal has heard both learned advocates appearing on behalf<br \/>\nof claimants as well as appellant insurance company. Learned advocate<br \/>\nMr. V.H. Kanazaria for appellant   insurance company has submitted<br \/>\nhis written arguments at Ex.26 and whatever contentions raised in<br \/>\nwritten statement, same has been referred and relied upon by<br \/>\nappellant insurance company before claims tribunal. The appellant<br \/>\ninsurance company has relied upon certain decisions of Apex Court as<br \/>\nwell as of this Court. Thereafter, claims tribunal has observed in<br \/>\nPara 8 and 9 as under:\n<\/p>\n<p> 8.\tNow,<br \/>\nit is well settled principles of law that the provisions of S.140 of<br \/>\nthe MV Act is based on  No Fault Liability  and the claimant has<br \/>\nprima facie proved factum of accident and involvement of the vehicle<br \/>\nas well as resultant permanent or partial disability and the<br \/>\ninsurance of the vehicle. The contention raised by the insurer as to<br \/>\nthe travelling of the applicant with goods in the carrier rickshaw<br \/>\nand legality and validity of the driving license of its driver is a<br \/>\nmatter of recording evidence and the same cannot be decided at this<br \/>\nstage. It is the specific contention of the applicant that he was<br \/>\ntravelling in the rickshaw along with his goods. Whether the<br \/>\napplicant was travelling in the said vehicle with goods or not may be<br \/>\ndecided only after recording evidence. So far the decisions relied on<br \/>\nby Mr. Kanzaria are concerned, in most of those cases, decisions have<br \/>\nbeen reached at final trial and not at the stage of deciding<br \/>\napplication under  No Fault Liability .\n<\/p>\n<p>9.\tNow,<br \/>\non perusal of the entire documentary evidence, it clearly transpires<br \/>\nthat the claimant has produced all the relevant documents satisfying<br \/>\nthe provisions of S.142 of the MV Act. Thus, the claimant is entitled<br \/>\nto get interim compensation of Rs.25,000\/- under Sec.140 of the MV<br \/>\nAct from all the opponents jointly and\/or severally. It may be<br \/>\nclarified that if, at the conclusion of trial, the opponent No.3<br \/>\nsucceeds to prove its plea for being exonerated from the liability,<br \/>\nit will be at liberty to recover the amount paid by it to the<br \/>\nclaimant from the owner of the vehicle.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Ms. Bhaya raised almost same contentions which were raised<br \/>\nbefore claims tribunal by advocate of insurance company. Learned<br \/>\nadvocate Ms. Bhaya submitted that driver of goods vehicle which was<br \/>\nbeing a goods carrying transport vehicle and driver was not having an<br \/>\nendorsement to drive transport vehicle, therefore, it amounts to<br \/>\nbreach of terms and conditions of policy and therefore, insurance<br \/>\ncompany cannot held liable to pay compensation. The claimants were<br \/>\ngratuitous passengers travelling in goods vehicle without being<br \/>\nhaving goods with them, therefore, she relied upon decision of Apex<br \/>\nCourt in case of Smt. Yallwwa reported in 2007 ACJ 1934, where, if<br \/>\ninsurance company raised statutory defence covered by Section 149(2)<br \/>\nof MV Act, even at the stage of interim application, such contention<br \/>\nmust have to be examined by claims tribunal.\n<\/p>\n<p>\tI<br \/>\nhave considered submissions made by learned advocate Ms. Bhaya and I<br \/>\nhave also perused interim orders passed by claims tribunal in both<br \/>\ncases, if the contention raised by learned advocate Ms. Bhaya are to<br \/>\nbe accepted at this stage, then, both appeals are required to be<br \/>\nadmitted by this Court, but, question is that whether such admission<br \/>\nof appeals are in interest of both parties or not, is to be<br \/>\nconsidered by this Court. If both appeals are admitted, naturally,<br \/>\nclaim petition filed by claimants under Section 166 of MV Act must<br \/>\nhave to be held up till first appeals are decided by this Court. The<br \/>\nquestion of merits is not to be examined at interim stage, otherwise,<br \/>\nthere is no scope to consider merits in 166 application. The<br \/>\ncontentions which are raised, require evidence from both sides,<br \/>\ntherefore, such detailed examination naturally not permissible while<br \/>\ndeciding interim application. However, if these both appeals are<br \/>\ndisposed of by this Court without expressing any opinion on merits<br \/>\nwith a direction to claims tribunal concerned to decide 166<br \/>\napplication independently without influence by interim order, it will<br \/>\nmeet end of justice between both parties.\n<\/p>\n<p>\tTherefore,<br \/>\nit is directed to claims tribunal concerned to decided 166<br \/>\napplication filed by claimants in both cases independently without<br \/>\ninfluence by present interim orders passed in both applications in<br \/>\naccordance with law after giving reasonable opportunities of hearing<br \/>\nto all respective parties.\n<\/p>\n<p>\tThe<br \/>\nclaimant is directed not to withdraw 166 application and not to<br \/>\nabandon 166 proceedings.\n<\/p>\n<p>\tIt<br \/>\nis directed to appellant insurance company to deposit entire awarded<br \/>\namount together with cost and interest before claims tribunal<br \/>\nconcerned within a period of one month from date of receiving copy of<br \/>\npresent order.\n<\/p>\n<p>\tAfter<br \/>\nrealising said amount from appellant insurance company, it is<br \/>\ndirected to claims tribunal concerned to pay 30% from it by account<br \/>\npay cheque in name of Arvindbhai Rambhai Vala and Ramjibhai Hirabhai<br \/>\nBajaniya, after proper verification in both cases, respectively.\n<\/p>\n<p>\tRest<br \/>\nof amount in both cases is to be invested in any Nationalised Bank<br \/>\ninitially for a period of three years in name of each respondent<br \/>\nclaimant individually with cumulative interest till 166 applications<br \/>\nare finally decided by claims tribunal concerned which requires<br \/>\nperiodical renewal till 166 applications are decided and claimants<br \/>\nare not entitled any amount of interest upon said FDR till 166<br \/>\napplications are decided by claims tribunal concerned finally.\n<\/p>\n<p>\tIt<br \/>\nis made clear by this Court that whatever amount received by<br \/>\nclaimants are subject to final outcome of 166 applications. In case,<br \/>\nif appellant insurance company will succeed in 166 application, then,<br \/>\nwhatever amount lying with claims tribunal may be refunded to<br \/>\nappellant insurance company by account payee cheque in its name,<br \/>\nafter proper verification.\n<\/p>\n<p>\tIn<br \/>\nview of above observations and directions, both appeals are disposed<br \/>\nof without expressing any opinion on merits.\n<\/p>\n<p>\tWhen<br \/>\nfirst appeals are disposed of by this Court today, no order is<br \/>\nrequired to be passed in civil applications.
