Learned APP waives<br \/>\nservice.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict who vide judgment and order dated 25\/2\/2010 rendered by the<br \/>\nLd. Addl. Sessions Judge, F.T.C., Bhavnagar, in Sessions Case No. 18<br \/>\nof 2009 has been convicted for the offences punishable under sections<br \/>\n302, etc., of the IPC and sentenced to undergo imprisonment for life<br \/>\nand fine, has  forwarded present application through jail seeking<br \/>\ntemporary bail for period of 45 days on the ground of making<br \/>\narrangement for finance for his family.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nforwarded with the application by the jail authority reveals that the<br \/>\napplicant convict has undergone 2 years and 8  months in jail. It<br \/>\nfurther transpires that the applicant convict has enjoyed temporary<br \/>\nbail,  furlough leave and parole each on one occasion  and<br \/>\nsurrendered in time before the jail authority.\n<\/p>\n<p>5.\t\tConsidering the facts<br \/>\nand circumstances of the case, the  application is allowed in part.<br \/>\nThe applicant convict is ordered to be released on  temporary bail<br \/>\nfor the period of 15 [fifteen] days from the date of his actual<br \/>\nrelease, upon furnishing personal bond in the sum of Rs.5,000\/-<br \/>\n[Rupees five thousand only] before the jail authority on usual terms<br \/>\nand conditions.
