The petitioner was granted licence to run fair-price<br \/>\nshop in the month of March 2006 on the basis that he being badly<br \/>\naffected person during communal riots.  Subsequently, the Scheme<br \/>\nknown as NFFW Scheme was introduced where under the workers or<br \/>\nlabourers were issued coupons and in lieu of wages they could obtain<br \/>\nwheat from fair-price shops on the basis of such coupons.   The<br \/>\npetitioner was also entrusted with this task.\u00a0  It appears from<br \/>\nthe record that the petitioner was required to get the supply of<br \/>\nwheat from the godown in-charge of the Mamlatdar.  In the month of<br \/>\nAugust 2006 the petitioner was supposed to procure the wheat from the<br \/>\ngo-down.  He, however, did not go for the reason that he was not well<br \/>\nand instead his father had gone.  His father, however, felt uneasy<br \/>\nand hence he returned leaving the tempo in-charge one Wahid and<br \/>\nFazal.  According to the petitioner, they were asked to deliver the<br \/>\nwheat at the fair-price shop of the petitioner.  It appears from the<br \/>\nrecord that instead of delivering the wheat at the shop it was being<br \/>\ntaken to Himatnagar Market Yard.  On the way, the vehicle was<br \/>\nintercepted and the fraud was detected.   After making departmental<br \/>\nenquiry it was learnt that the petitioner was also hand in glove in<br \/>\nthis fraud.  The Mamlatdar has, therefore, launched prosecution<br \/>\nagainst the petitioner and aforesaid two persons.  It is the case of<br \/>\nthe petitioner that it was the Mamlatdar and aforesaid two persons,<br \/>\ni.e., Wahid and Fazal who conspired together to dispose of the wheat<br \/>\ndirectly by selling it in the Himatnagar Market Yard.  However, the<br \/>\nauthorities below have found no substance in this allegation.  There<br \/>\nis definite finding given by respondents Nos.1, 2 and 3 that the<br \/>\npetitioner was very much involved in this fraud.  Hence, the licence<br \/>\nand authorisation have been cancelled.\n<\/p>\n<p>\tI<br \/>\nhave heard Mr Prajapati for the petitioner and Ms Falguni Patel,<br \/>\nlearned Assistant Government Pleader for the respondent.  Mr<br \/>\nPrajapati has submitted that the Mamlatdar in collusion with Wahid<br \/>\nand Fazal tried to dispose of the wheat meant for the labourers and<br \/>\nthe petitioner has been made a scapegoat.  He has further submitted<br \/>\nthat respondent No.3 has no power to cancel the licence.  As against<br \/>\nthat, Ms Patel has supported the orders passed by the authorities<br \/>\nbelow.  I have considered the facts carefully and also the<br \/>\nsubmissions of the learned counsel for the parties.  So far as the<br \/>\nsecond submission of Mr Prajapati is concerned, it hardly impresses<br \/>\nme because the authority which has a power to grant licence has power<br \/>\neven to cancel it.   It is no use in saying that there is no<br \/>\nprovision which empowers him to cancel the licence.  So far as the<br \/>\nsubmission based on facts is concerned, it cannot be entertained<br \/>\nherein because, all through out, the concurrent findings show that<br \/>\nthe petitioner was very much involved in the conspiracy and fraud.<br \/>\nIn view of the same, the decision taken by respondent No.3 in<br \/>\ncancelling the licence and authorisation is just and proper.   This<br \/>\npetition has no merits.
