Lalu Yadav, son of Naresh Yadav\n                         Both resident of village - Mirzapur Changeri, P.S. -\n                         Banka (Barahat), District - Banka.\n                                                                -------- Petitioners.\n                                               Versus\n                   The State of Bihar                    -----Opposite Party\n                                               *****\n<\/pre>\n<p>05.   15.09.2011                  Heard learned counsel for the petitioners and<\/p>\n<p>                       learned Additional Public Prosecutor for the State.<\/p>\n<p>                                  The two petitioners, apprehending their<\/p>\n<p>                       arrest in connection with Banka (Barahat) P.S. Case<\/p>\n<p>                       No.     302\/2009, for the offences under sections<\/p>\n<p>                       341\/323\/307\/34 of the Indian Penal Code, pending in<\/p>\n<p>                       the court of Chief Judicial Magistrate, Banka, are<\/p>\n<p>                       named accused in this case with allegation of inflicting<\/p>\n<p>                       injuries upon informant and her husband while they<\/p>\n<p>                       were seeking due share in respective properties.<\/p>\n<p>                                 Submission is that there is counter version also<\/p>\n<p>                       and petitioner&#8217;s side including petitioner no. 2 and his<\/p>\n<p>                       wife both have been assaulted by husband of the<\/p>\n<p>                       informant. Further submission is that injuries caused<\/p>\n<p>                       upon informant and her husband are simple in nature,<\/p>\n<p>                       whereas injuries caused upon wife of petitioner no. 1 is<br \/>\n           grievous in nature.\n<\/p>\n<p>                    Learned Additional Public Prosecutor while<\/p>\n<p>          objecting the prayer pointed out that earlier petitioner&#8217;s<\/p>\n<p>          prayer for anticipatory bail was permitted to be<\/p>\n<p>          withdrawn on 11th November 2009 by learned Sessions<\/p>\n<p>          Judge, but instead of surrendering before the court below<\/p>\n<p>          for which he withdrawn another application was filed<\/p>\n<p>          and subsequently rejected.\n<\/p>\n<p>                    Further the injuries sustained by the informant<\/p>\n<p>          and her husband is on vital part of the body i.e. head.<\/p>\n<p>          Considering the facts and circumstances of the case<\/p>\n<p>          petitioners are not entitled the privilege sought.<\/p>\n<p>          Accordingly, prayer for anticipatory bail of the<\/p>\n<p>          petitioners is refused.\n<\/p>\n<\/p>\n<pre>Rajeev\/                         ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Naresh Yadav &amp; Anr vs The State Of Bihar on 15 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.17935 of 2011 1.
