SHAH\n\t\t\n\t\n\n \n\nDate\n: 29\/07\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\nCriminal Miscellaneous Application under Article 226 of the<br \/>\nConstitution of India r\/w under Section 482 of the Code of Criminal<br \/>\nProcedure has been preferred by the petitioners-out of petitioner<br \/>\nno.1-original accused no.1 to quash and set aside the impugned<br \/>\ncomplaint being CR.I- No. 16 of 2011 registered with the Sankheda<br \/>\nPolice Station for the offences punishable under Sections 363, 366<br \/>\nand 114 of the Indian Penal Code.\n<\/p>\n<p>2.0.\tThough<br \/>\nserved, nobody appears on behalf of respondent no.2-original<br \/>\ncomplainant. Heard Shri Kapadia, learned advocate for the applicant<br \/>\nand Shri Rawal, learned APP for th respondent State.\n<\/p>\n<p>3.0.\tIt appears<br \/>\nthat respondent no.2-original complainant has lodged the complaint\/<br \/>\nFIR with the Sankheda Police Station against the petitioner no.1<br \/>\nherein for the offences punishable under Sections 363, 366 and 114 of<br \/>\nthe Indian Penal Code, which has been registered as CR-I- No. 16 of<br \/>\n2011 alleging inter alia that his daughter aged 17 years and 10<br \/>\nmonths has been abducted by the petitioner no.1 to marry her. Being<br \/>\naggrieved and dissatisfied with the same, the applicants have<br \/>\npreferred present Special Criminal Application to quash and set aside<br \/>\nthe impugned FIR.\n<\/p>\n<p>4.0.\tShri Kapadia,<br \/>\nlearned advocate for the petitioners has submitted that petitioners<br \/>\nhave married after attaining the age of majority  and that they are<br \/>\nstaying happily. It is further submitted that the petitioner no.2 is<br \/>\nthe daughter of the original complainant has run away \/ gone with the<br \/>\npetitioner no.1 voluntarily as she was in love with the petitioner<br \/>\nno.1 and they wanted to marry. It is submitted that subsequently both<br \/>\nthe applicants have already married. Therefore, it is requested to<br \/>\nquash and set aside the impugned FIR as the same is nothing but an<br \/>\nabuse of process of law and Court and to continue the said criminal<br \/>\nproceedings against the applicants is unnecessary harassment to them<br \/>\nand now even daughter of the original complainant, who is now wife of<br \/>\nthe applicant no.1.\n<\/p>\n<p>5.0.\tHaving heard<br \/>\nShri Kapadia, learned advocate for the petitioner and Shri Rawal,<br \/>\nlearned APP for the respondent State and considering the fact now the<br \/>\npetitioners have already married i.e. applicant no.1 has now already<br \/>\nmarried with the petitioner no.2 -daughter of original complainant,<br \/>\nwho at the relevant time when she run away with the petitioner no.1,<br \/>\nwas aged 17 year and 10 months, this is a fit case to exercise the<br \/>\npowers under Section 482 of the Code of Criminal Procedure as it<br \/>\nappears that daughter of original complainant run away with the<br \/>\napplicant no.1 voluntarily as both of them were in love and they have<br \/>\nmarried now. A statement was made by  applicant no.1 who was<br \/>\npersonally present in the Court confirming the marriage of the<br \/>\npetitioner and that they are staying happily. In view of the above,<br \/>\nthis Court is of the opinion that to continue the criminal<br \/>\nproceedings against the applicants, more particularly, applicant no.1<br \/>\nwould be abuse of process of law and Court and is unnecessary<br \/>\nharassment to them.\n<\/p>\n<p>6.0.\tIn<br \/>\nview of the above and for the reasons stated above, present<br \/>\napplication succeed and the impugned complaint being CR.I- No. 16 of<br \/>\n2011 registered with the Sankheda Police Station is hereby quashed<br \/>\nand set aside. Rule is made absolute to the aforesaid extent.
