    Petitioner is the first defendant in O.S.No.<\/p>\n
74\/07 on the file of the Sub Court, Kochi.      The<\/p>\n
grievance of the petitioner is that the Sub Judge,<\/p>\n
Kochi  is  taking  a  partisan  attitude  and  that<\/p>\n
therefore, O.S.No.74\/07 aforesaid be transferred to<\/p>\n
some other court.    The reasons submitted by the<\/p>\n
learned counsel for the petitioner are that though<\/p>\n
the plaintiff and the defendants filed draft issues<\/p>\n
in the suit, the court accepted only the issues<\/p>\n
suggested by the plaintiff; that the petitioner<\/p>\n
moved I.A.No.622\/08 to consider the draft issues<\/p>\n
submitted by him as well and that the learned Sub<\/p>\n
Judge, vide Annexure-V order, dismissed the said<\/p>\n
application holding that it is not maintainable,<\/p>\n
since she has gone through the pleadings of either<\/p>\n
side and also through the draft issues submitted by<\/p>\n
both sides and accordingly raised the issues.<\/p>\n
    2.    The  above  order  was  assailed  by  the<\/p>\n
petitioner  before   this   Court  filing   W.P.(C)<\/p>\n
TPC 29\/09                2<\/span><\/p>\n
No.15792\/08   and this   Court,  vide   Annexure-VI<\/p>\n
judgment, disposed of the writ petition observing<\/p>\n
that the fact that either plaintiff has filed a<\/p>\n
draft issue or the defendants have filed, does not<\/p>\n
mean that the court has to accept the same; that it<\/p>\n
is for the court to frame the material issues<\/p>\n
relevant and necessary for disposing of the case<\/p>\n
based on the pleadings and therefore, there is no<\/p>\n
reason to interfere with the issues framed by the<\/p>\n
trial court; that however, in I.A.No.622\/08, there<\/p>\n
was no specific prayer to frame any particular<\/p>\n
issue and there is no reason to interfere with the<\/p>\n
said    order and that  if  the  grievance of   the<\/p>\n
petitioner is that any particular issue, which<\/p>\n
arises on the pleadings and necessary to be decided<\/p>\n
for    disposing of  the  suit,   is  not   framed,<\/p>\n
petitioner    is at   liberty   file   a   petition<\/p>\n
specifically requesting the court to frame that<\/p>\n
issue as an additional issue and that the court<\/p>\n
shall consider the petition on merits and pass<\/p>\n
appropriate orders.\n<\/p>\n
TPC 29\/09                 3<\/span><\/p>\n
     3.   Pursuant to the disposal of the above writ<\/p>\n
petition    vide  Annexure-VI  judgment,  petitioner<\/p>\n
moved    Annexure-VII  application   (I.A.No.876\/08)<\/p>\n
praying for an additional issue being raised to the<\/p>\n
following effect:\n<\/p>\n<\/p>\n
     “Whether the court fee paid is sufficient?”<\/p>\n
Obviously, the said issue is irrelevant for the<\/p>\n
reason that in a suit valued under Section 37(2) of<\/p>\n
the    Kerala Court  Fees  and  Suit  Valuation  Act<\/p>\n
(hereinafter referred to as ‘the Act’) court fee<\/p>\n
payable has been paid.    The real issue should have<\/p>\n
been whether the suit has been properly valued and<\/p>\n
court fee paid.    However, the court considered the<\/p>\n
said issue and rendered Annexure-X order holding<\/p>\n
that the court fee paid under Section 37(2) of the<\/p>\n
Act is sufficient and proper, consequent on the<\/p>\n
observation made by the court below that though the<\/p>\n
first defendant argued that the court fee has to be<\/p>\n
paid under Section 37(1) of the Act, it is the<\/p>\n
averments in the plaint that has to be the basis<\/p>\n

for valuation of the suit for the purpose of<\/p>\n
payment of court fee in a suit for partition and<\/p>\n
not the averments in the written statement and that<\/p>\n
the plaint averments do not indicate that the<\/p>\n
plaintiff has been excluded from possession.     The<\/p>\n
finding rendered by the court below cannot be<\/p>\n
viewed as an order passed      taking any partisan<\/p>\n
attitude. In the nature of the issue that was<\/p>\n
raised   as  desired  by  the  petitioner,  it   was<\/p>\n
sufficient for the court to say that the court fee<\/p>\n
paid under Section 37(2) of the Act is sufficient<\/p>\n
without observing anything about the valuation.<\/p>\n
Thus, the petitioner also committed errors and<\/p>\n
there is no meaning in raising a complaint against<\/p>\n
the officer concerned.   There is no merit in this<\/p>\n
transfer petition and the transfer has been moved<\/p>\n
on account of misunderstanding of the party or the<\/p>\n
counsel as regards position of law.\n<\/p>\n
     This transfer petition is dismissed.<\/p>\n
