Justice R.BASANT\n\n Dated :24\/07\/2008\n\n O R D E R\n                            R.BASANT, J\n                         ----------------------\n                      R.P.F.C.No.233 of 2008\n                   ----------------------------------------\n               Dated this the 24th day of July 2008\n\n\n                              O R D E R\n<\/pre>\n<p>      The petitioner in this R.P.F.C assails an order passed under<\/p>\n<p>Section 125 Cr.P.C obliging him to pay maintenance at the rate<\/p>\n<p>of Rs.1,000\/- per mensum to the second claimant admittedly his<\/p>\n<p>minor child. The claim of the first petitioner\/wife under Section<\/p>\n<p>125 Cr.P.C was turned down by the Family Court.<\/p>\n<p>      2.   Marriage is admitted.                  Paternity is admitted.<\/p>\n<p>Separate residence is not disputed. What then is the contention<\/p>\n<p>regarding the claim of the minor child? The learned counsel for<\/p>\n<p>the petitioner only submits that the quantum of maintenance<\/p>\n<p>awarded is excessive.\n<\/p>\n<p>      3.   There is a dispute about the nature of employment<\/p>\n<p>about the petitioner. Be that as it may, the amount presently<\/p>\n<p>ordered &#8211; Rs.1,000\/- per mensum                is perfectly justified even<\/p>\n<p>assuming that the petitioner has no employment whatsoever and<\/p>\n<p>he is just an able bodied person. He is expected to work, earn<\/p>\n<p>his livelihood and support his child. In any view of the matter, I<\/p>\n<p>am satisfied that the quantum of maintenance fixed does not<\/p>\n<p><span class=\"hidden_text\">R.P.F.C.No.233\/08                  2<\/span><\/p>\n<p>warrant interference invoking the revisional jurisdiction of<\/p>\n<p>superintendence and correction vested in this court.<\/p>\n<p>      4.
