Agrawal,J.\n<\/pre>\n<p>Hon&#8217;ble Abhinava Upadhya,J.\n<\/p>\n<p>The present contempt appeal has been filed against the<br \/>\norder of the learned Single Judge dated 28.4.2004 by which<br \/>\nthe contempt petition filed by Shail Kumari and others was<br \/>\ndisposed of by awarding cost of Rs. 20,000\/- (Rs. Twenty<br \/>\nThousand Only) on the respondents.\n<\/p>\n<p>We have heard Sri Bhanu Pratap Singh, learned counsel for<br \/>\nthe appellant.\n<\/p>\n<p>Brief facts are that there were seven Basic Schools with 62<br \/>\nteaching and non-teaching staff run by Churk Cement<br \/>\nFactory and Dala Cement Factory. These were the<br \/>\nGovernment Companies incorporated under Section 617 of<br \/>\nthe Companies Act, 1956 (in short the Act) which went in<br \/>\nliquidation and, therefore, the salary of the teachers and<br \/>\nnon-teaching staff was not being paid. The employees of the<br \/>\nCollege filed a writ petition with the aforesaid grievance and<br \/>\nthis Court vide order dated 6.6.2002 directed the State<br \/>\nauthorities to consider for taking over the institutions under<br \/>\nthe Basic Education Board and also to provide financial aid<br \/>\nin public interest. The said consideration by the Government<br \/>\nwas directed to be done within a period of four weeks. The<br \/>\nGovernment in turn, in its usual manner, took more than four<br \/>\nweeks. In fact it took about two years to pass an order being<br \/>\n order dated 12.2.2004 holding that there is no provision for<br \/>\ntaking over such institution. The respondents then filed the<br \/>\ncontempt petition on the ground that the order of the Court<br \/>\nhas not been complied with in its true letter and spirit as the<br \/>\ndesire of the Court was that the State Government should<br \/>\ntake over the institution and run the same as it runs other<br \/>\nrecognized Basic Schools. through the Parishad. The<br \/>\nlearned Single Judge while considering the pleas raised by<br \/>\nthe parties came to the view that the contempt proceeding<br \/>\ncannot proceed any further as the order of the Court has<br \/>\nnow been complied with by passing an order dated<br \/>\n12.2.2004 by which the governmental authorities after<br \/>\nconsidering the issue declined to take over those institutions.\n<\/p>\n<p>According to the learned Single Judge the said order dated<br \/>\n12.2.2004 was in compliance of the High Court&#8217;s order dated<br \/>\n6.2.2002 and has also held that in case the applicants<br \/>\ntherein are aggrieved by the order, they are at liberty to<br \/>\nchallenge it before the appropriate forum and thus, refused<br \/>\nto draw contempt proceedings against the appellants.<br \/>\nHowever, in view of the fact that instead of considering the<br \/>\nmatter within four weeks as directed the authorities took two<br \/>\nyears, therefore, cost of Rs. 20,000\/- was imposed.\n<\/p>\n<p>Sri Singh, learned counsel for the appellant then submitted<br \/>\nthat once the learned Single Judge has found that the order<br \/>\nof the Court has been complied with, he ought not to have<br \/>\nimposed cost of Rs. 20,000\/-. He further submits that if the<br \/>\nCourt found the respondents&#8217; guilty of contempt, it could<br \/>\nhave framed charges and then pronounced its verdict but in<br \/>\nthe present case having found that the order of the Court<br \/>\nhas been complied with, the learned Single Judge should<br \/>\nnot have imposed cost.\n<\/p>\n<p>We have considered the submissions made by the learned<br \/>\ncounsel and have gone through the order of the learned<br \/>\n Single Judge and have perused the ground of appeal and<br \/>\nannexures annexed along with the memo of appeal. We are<br \/>\nall too familiar with the functioning of the Government where<br \/>\nthere is a tendency of passing the buck and pushing the file<br \/>\nfrom one table to another and no single individual can be<br \/>\nheld to be accountable for the working and, therefore, some<br \/>\ntimes inordinate delay are caused without any particular<br \/>\nreason or motive.\n<\/p>\n<p>In this view of the matter, we respectfully disagree with the<br \/>\nlearned Single Judge in imposing cost of Rs. 20,000\/- and,<br \/>\ntherefore, the order imposing cost is set-aside.\n<\/p>\n<p>In terms of what has been stated above, the appeal is,<br \/>\ntherefore, allowed.\n<\/p>\n<p>Order Date :- 29.7.2010<br \/>\nSKM\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Hari Raj Kishore vs Shail Kumari &amp; Others on 29 July, 2010 Court No. &#8211; 32 Case :- SPECIAL APPEAL No. &#8211; 648 of 2004 Petitioner :- Hari Raj Kishore Respondent :- Shail Kumari &amp; Others Petitioner Counsel :- Bhanu Pratap Singh Respondent Counsel :- Yogesh Agarwal Hon&#8217;ble R.K.
