JUSTICE BIRENDRA PRASAD VERMA\n\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>5   01-08-2011                   Feeling aggrieved by the judgment and order dated<br \/>\n                 11th May 2011 passed by the learned single Judge in above CWJC<br \/>\n                 No. 8353 of 2011, the writ petitioner has preferred the present<br \/>\n                 Appeal under Clause 10 of the Letters Patent.\n<\/p>\n<p><span class=\"hidden_text\"> Patna High Court LPA No.973 of 2011 (5) dt.01-08-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                           2<\/span><\/p>\n<p>                              According to the appellant, after following due<br \/>\n             procedure as envisaged by Paragraphs 5 &amp; 6 of the Guidelines<br \/>\n             issued for selection of Anganbari Sevika and Anganbari Sahayika<br \/>\n             under the Integrated Child Development Project, the appellant was<br \/>\n             selected for the post of Anganbari Sevika. She was however, not<br \/>\n             sent for training. On the complaint made by the respondent no. 12,<br \/>\n             the Commissioner, Bhagalpur set aside the selection of the<br \/>\n             appellant and directed the respondent no. 12 Sangita Kumari to be<br \/>\n             appointed as Anganbari Sevika.\n<\/p>\n<p>                              The challenge to the said order before the learned<br \/>\n             single Judge has failed. Therefore, the present Appeal.\n<\/p>\n<p>                              It is not in dispute that the respondent no. 12 was<br \/>\n             better qualified than the appellant. Challenge to the appointment<br \/>\n             of the respondent no. 12 is that she is the daughter-in-law of a<br \/>\n             retired Government employee.\n<\/p>\n<p>                              The Commissioner, Bhagalpur held that kith and kin<br \/>\n             of a retired Government employee were not excluded from being<br \/>\n             appointed as Anganbari Sevika or Anganbari Sahayika. The<br \/>\n             respondent no. 12, therefore, had right to be selected and<br \/>\n             appointed as Anganbari Sevika, she being better qualified for the<br \/>\n             post.\n<\/p>\n<p>                              Learned advocate Mr. Pramod Mishra has appeared<br \/>\n             for the appellant. He has relied upon Paragraph 5 of the<br \/>\n             Guidelines. He has submitted that the relatives of various<br \/>\n             categories of persons receiving some benefit from the State<br \/>\n             Government have been excluded from being selected as<br \/>\n             Anganbari Sevika. A retired Government employee also receives<br \/>\n             pension from the Government. His relatives, therefore, cannot be<br \/>\n             appointed as Anganbari Sevika.\n<\/p>\n<p><span class=\"hidden_text\">           Patna High Court LPA No.973 of 2011 (5) dt.01-08-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                     3<\/span><\/p>\n<p>                                        We do appreciate the submission made by Mr.<br \/>\n                       Mishra. We may, however, note that the said Paragraph 5<br \/>\n                       specifically excludes the kith and kin of various categories of<br \/>\n                       persons      including the Government and Semi-Government<br \/>\n                       servants. However, the relatives of the retired Government<br \/>\n                       servants are not excluded either expressly or by implication.\n<\/p>\n<p>                                        In absence of specific exclusion, the kith and kin of a<br \/>\n                       retired     Government         employee    cannot   be   excluded   from<br \/>\n                       consideration for appointment as Anganbari Sevika or Anganbari<br \/>\n                       Sahayika. The respondent no. 12 admittedly having better<br \/>\n                       qualification, the appellant could not have a better claim than the<br \/>\n                       respondent no. 12.\n<\/p>\n<p>                                        The Appeal is dismissed in limine.<\/p>\n<pre>\n\n\n\n                                                      (R.M.
