This appeal is directed against the 4_<\/p>\n

2. By the impugned ovrdter~,._ppthe”‘ Appel1a;te:~-Court has<\/p>\n

\npetition. There-‘fore,  <\/p>\n
3(1),. _ In  the  are; The appellant filed suit in<\/p>\n
:,ii'()v..S…1\\A\u00a7g”_~7\u20ac’13.]’9O’.._for ‘declaration. it was dismissed on<\/p>\n
19,1Thehappellant preferred appeal before the<\/p>\n
  Shimoga, in R.A.No.28\/1.998. It was<\/p>\n
“”1-:l'[trai’isferredvto District Judge, Shirnoga and renumbered as<\/p>\n
  \/2005.\n<\/p>\n

(ii) The appellant had engaged the services of<\/p>\n
Sri.H.Ranganatha Rao, Advocate. He left the professiolnpand<\/p>\n
went to Bangalore. The \ufb01le was  <\/p>\n
Sri. H . S . Kumaraswamy, Advocate. Heppp>appea_I:ed.–4on   ‘ all  <\/p>\n
He had told the appellant that he <\/p>\n
the case is taken up and his p1’ese_nCe is not reV:qli,iiifedVVValnd hep’<\/p>\n
would inform the appellant abouit:’\u00bbsta.ges .o1″~the ease. The
\nappellant believed it and   } .4 V\n<\/p>\n

appellant tried.    -\u00bb.eou’ns_elV _Sri.H.S.KumaraswaIny<\/p>\n
and Came Advocate, has
\nleft Shimolgavland’Went_lllte.:fChickmagalore. Thereafter, the<\/p>\n
appellant ..oame”t.o   the appeal was dismissed for<\/p>\n

   llappellant was not informed about the Case<\/p>\n
 Coiisralelfhas misled him. The appellant has prayed<\/p>\n
 of delay and restoration of the appeal. The<\/p>\n
 “below holding that the appellant has failed to explain<\/p>\n

the delay, has dismissed the LA. and consequently, the misc.<\/p>\n
petition. Therefore, this appeal.\n<\/p>\n
4. The learned counsel for the appellant contended<\/p>\n
that the impugned order cannot be sustained in law. ‘l:.?I”es.a1so<\/p>\n
submitted that the appellant had engaged <\/p>\n
Sri.H.Ranganatha Rao, Advocate, and he shifted.’4_:toV  <\/p>\n
and the case was entrusted  <\/p>\n
Advocate and he did not informilgthe appellant <\/p>\n
and the appellant came to knoW_’_4_d:a-b:out_ the  of the<\/p>\n
case only during the lasvt””‘u}eek-_ 2007. He also<\/p>\n
subrr1ittedFtha.t’ ‘t.o’be considered liberally and by<\/p>\n
imposing reasonablle  appellant may be given an<\/p>\n
v..opport1;1’n_ityld’to contest___the matter on merits. He, therefore,<\/p>\n
st-.1_bmitt.ed–.tha’t.._the impugned order cannot be sustained in<\/p>\n
 law.  his submission, he placed reliance on the<\/p>\n

5. As against this, the learned Counsel for the<\/p>\n
respondent submitted that, the Appellate Court, Qflldpjtoper<\/p>\n
consideration of the material on record, has rightly.’;reje!:_ted<\/p>\n
the application and therefore, the impugned <\/p>\n
call for interference. He also submitted  eh’<\/p>\n
failed to explain the delay and therefore” the <\/p>\n
does not call for interference. Healso submhittedt that the suit
\nwas filed in the year l99lQ–…gil:i’id   dismissed in the
\nyear 1998 and there’after,,a”p’peal VWas._llled,:..ir’il’ aA.No.28\/ 1998<\/p>\n
and it was,’tremsterredl’and.::re.n’umbered as R.A.N0.61\/2005.<\/p>\n
Further he su”o._niitVted_that’ tlielappellarit and his counsel were<\/p>\n
not  in proseeuting the appeal though sufficient<\/p>\n
opportuniiyv\u00e9wastgivpen. He also submitted that the appeal has<\/p>\n
\u00a2:1’d26.9.2005 and the miscellaneous petition<\/p>\n
 beenlin the year 2008 and the deiay in filing the<\/p>\n
 miscellaneous petition has not been explained. He also<\/p>\n
V’ .s_lubmpitted that, the appellant has stated in his cross<\/p>\n

examination that Smt.Parvathamma died on 25.11.2005 and
\nhe met his counsel tw0–three days thereafter and infprmed<\/p>\n
about the death of Smt.ParVathamma which is <\/p>\n
therefore, submitted that the impugned order    <\/p>\n
interference.\n<\/p>\n
6. I have carefully considered the<\/p>\n
by the learned counsel for the\n<\/p>\n
7. The point that arises :.fQrd1rny c6ns.ide’\u00a7rati0n is,<\/p>\n
Whether the impugned order<\/p>\n

1990. The decree hasap.een”_.’tpassed on l3.L W38 dismissing<\/p>\n
the  appelianthas preferred appeal in R.A.N0.28\/98<\/p>\n
beforethe Civil Judge, Shimoga. Thereafter, the<\/p>\n
:”n.__.pv_appea3has Vbevenllltransferred to District Judge, Shimoga and<\/p>\n
_::._p_r4entimbeIedwas4R.A.No.61\/ 2005. The appellant has engaged<\/p>\n
 t_heif”sleif\/ices of Sri.H.Ranganatha Rao, Advocate. Thereafter,<\/p>\n
T.    appellant has engaged the services of<\/p>\n
V.\n<\/p>\n
Sri.H.S.Kumaraswamy. Advocate and he has \ufb01led Vakalath on
\n8.6.2005. Several adj ournments have been given.–.'”–._ The<\/p>\n
appellant and his counsel have not appeared. <\/p>\n
the appeal has been dismissed for nomprosle-Qution: <\/p>\n

26.9.2005:v’tltilllll’ th\u00e9tpiasiilwv\u00e9eigipi of Nldve\ufb01qber 2007, nothing has
\nbeen donelllibythe  know about his case. The<\/p>\n
records   eondu-ctlvsof the appellant indicate. the<\/p>\n
I-‘:’a.pp’e11VaI1t. “not  in prosecuting the appeal. The<\/p>\n
learneci coui1.sel the appellant placed reliance on some<\/p>\n
wltlecisioiis. ,__”li1.FM\/s.Syndicate Bank, Shoolay Branch,<\/p>\n

observation that the banking institutions are heavily over-
\nstaffed and the employees are well remunerated, but the
\nConduct of the cases is Very sluggish. In SI-IIV KUMAR vs.<\/p>\n
DARSHAN KUMAR<\/a> reported in (2009) 2 SCC page:<\/p>\n
appeal is restored for the reason, the appellant_.Ajc{.<as4y<\/p>\n

9. In the present””Case,’–  is not diligent<\/p>\n
in prosecutingthvel’t\u00e9a.se.._ appeal has been dismissed on<\/p>\n
26.9.2005.  not made any efforts to know<\/p>\n
about v_\u00bb\u00bb1i:isl:__lCase l.lt’illA.,_ij_\\_T__cy).vember 2007. No explanation is<\/p>\n
to-rti1elomir1g.’~Therefore, in my considered view, the Appellate<\/p>\n
.’lW,__.pCourt. was  in rejecting the application and the<\/p>\n
rriiseellaneous petition. Therefore, the impugned order does<\/p>\n
 for interference. There is no merit in this appeal and<\/p>\n
H  -.therefore, it is liable to be dismissed.<\/p>\n
10. Accordingly, the appeal is dismissed.
