The stand of the appellants before the<br \/>\nHigh Court and in this Court is that all the respondents had<br \/>\nbeen\tinitially    appointed\t    as\t  Lower\t    Division<br \/>\nClerk-cum-Assistant  Octroi  Superintendents and on  several<br \/>\noccasions  they have been transferred to the general section<br \/>\nand  from the general section to the octroi section.   There<br \/>\nis   no\t  separate  cadre  of  Octroi\tSuperintendents\t  or<br \/>\nInspectors.   When  all\t the  respondents  and\tother  Lower<br \/>\nDivision   Clerks   were  holding   the\t posts\twhich\twere<br \/>\ninter-changeable  and  within one cadre, transfer  from\t one<br \/>\npost  to another cannot be really questioned.  The stand  of<br \/>\nthe respondents has been that under Section 81 of the Orissa<br \/>\nMunicipal  Act\t[hereinafter referred to as the\t Act]  the<br \/>\nState Government is empowered to create a Local Fund Service<br \/>\nand  can make rules regulating the classification, method of<br \/>\nrecruitment,  conditions  of  service, pay  and\t allowances,<br \/>\ndiscipline   and  conduct  of\tthe  officers  and  servants<br \/>\nbelonging  to the Local Fund Service and such rules may vest<br \/>\njurisdiction  in  relation  to\tsuch service  in  the  State<br \/>\nGovernment  or in such other authority or authorities as may<br \/>\nbe prescribed therein.\tThe proviso to Section 81 stipulates<br \/>\nthat  the terms and conditions of service shall not be\tless<br \/>\nfavourable  than which were applicable immediately prior  to<br \/>\nsuch constitution.  Rule 3(1) prescribes that the Local Fund<br \/>\nService\t shall\tbe  constituted by the State  Government  as<br \/>\nprovided  under Section 81(1) of the Act which includes such<br \/>\nof  the\t posts\tof the municipalities as  specified  by\t the<br \/>\nGovernment  from  time\tto  time by order  in  that  behalf.<br \/>\nSub-rule  (2) therein indicates that on constitution of\t the<br \/>\nservice\t under\tsub-rule  (1) the posts of  the\t equal\ttime<br \/>\nscales\thaving duties and degree of responsibilities of\t the<br \/>\nsame  nature in the municipalities shall form one cadre.  It<br \/>\nis submitted that a combined reading of these two provisions<br \/>\nwould  make  it\t clear\tthat   the  State  Government  while<br \/>\nconstituting the Local Fund Service and while constituting a<br \/>\ncadre  of  the\tmunicipal  employees is guided\tby  the\t two<br \/>\nconditions,  namely,  (i)  that they must be in\t equal\ttime<br \/>\nscales and, (ii) their duties and degree of responsibilities<br \/>\nof  the posts must be of the same nature.  Therefore, it  is<br \/>\ncontended that the action of the respondents in constituting<br \/>\na  common  cadre of officials in the octroi section and\t the<br \/>\ngeneral\t section is not proper.\t This argument was  accepted<br \/>\nby  the Full Bench of the Orissa High Court and,  therefore,<br \/>\nthe action taken by the appellants was set aside.\n<\/p>\n<p>      The  High Court took the view that the respondents who<br \/>\nwere  working  in  the\toctroi\t section  cannot  claim\t  to<br \/>\nconstitute  an independent cadre by themselves.\t But it took<br \/>\nthe  view that the guidance as to nature of responsibilities<br \/>\nand  duties  discharged by respondents provided\t under\tRule<br \/>\n3(2)  of the Rules, adverted to earlier, was ignored by\t the<br \/>\nauthorities and, therefore, they could not class in the same<br \/>\ncadre as those in the general cadre.\n<\/p>\n<p>      In this batch of appeals the arguments advanced by the<br \/>\nrespective  parties  before  the High Court  are  reiterated<br \/>\nbefore us.  When the respondents had been appointed as Lower<br \/>\nDivision  Clerk-cum-Assistant Octroi Superintendents and the<br \/>\nposts  in the octroi section and the general section in\t the<br \/>\nmunicipalities\twere  inter-  changeable prior\tto  impugned<br \/>\nRules  and  action thereto and when the finding of the\tHigh<br \/>\nCourt  is  that those working in the octroi section  do\t not<br \/>\nconstitute a separate cadre, we fail to understand as to how<br \/>\nthe  respondents can claim that while constituting the cadre<br \/>\nthey  cannot  be  grouped along with others working  in\t the<br \/>\ngeneral section.\n<\/p>\n<p>      The  question  of\t parity\t in   pay  and\tduties\t and<br \/>\nresponsibilities  would arise only in case of constituting a<br \/>\ncadre  by integrating several cadres.  In the present cases,<br \/>\nthere\tis  no\tintegration  of\t  cadres  inasmuch  as\t the<br \/>\nrespondents  and  others working in the common\tcadre  would<br \/>\nconstitute  one single cadre, as noticed by the High  Court.<br \/>\nIf  that position is correct, it hardly lies in the mouth of<br \/>\nthe  respondents to contend that they cannot be equated with<br \/>\nother  employees  working  in  the  other  sections  of\t the<br \/>\nmunicipalities.\t  In the present case, all of them belong to<br \/>\none  cadre  and\t it  is the first time\twhen  the  State  is<br \/>\nconstituting   the  cadre  as\tprovided  under\t the  Rules.<br \/>\nTherefore,  when  the posts were inter- changeable  and\t the<br \/>\nresponsibilities  discharged  by the respondents and  others<br \/>\nwere  identical in constituting such a service the action of<br \/>\nthe State appears to us to be unexceptionable.\n<\/p>\n<p>      In  this\tview of the matter, we think the High  Court<br \/>\nwas  not  justified in quashing the transfer order  and\t the<br \/>\nview taken in <a href=\"\/doc\/1951397\/\">Rabinarayan Vyas v.  State of Orissa<\/a> in O.J.C.<br \/>\nNo.   930  of  1979 appears to be correct and not  the\tview<br \/>\ntaken  in  other  cases\t referred to in the  course  of\t the<br \/>\njudgment of the Full Bench decision.\n<\/p>\n<p>      The  appeals,  therefore, stand allowed.\tHowever,  in<br \/>\nthe  circumstances  of the case, each of the  parties  would<br \/>\nbear their own costs.  Civil Appeal No.\t .\/99 [@ S.L.P.<br \/>\n(C) NO.\t 16192\/93]<\/p>\n<p>      Leave granted.\n<\/p>\n<p>      In  this\tappeal,\t the appellants called\tin  question<br \/>\ncircular  dated November 17, 1990 from the State  Government<br \/>\nto  the Executive Officers of all the Municipalities in\t the<br \/>\nState  to  revert employees promoted irregularly and  report<br \/>\ncompliance  by December 15, 1990.  The appellants approached<br \/>\nthe  High  Court and status quo was continued under  interim<br \/>\norders.\t  Thereafter  the High Court, after considering\t the<br \/>\nentire\tmatter\tobserved  that they would not  have  allowed<br \/>\nreversion  of the appellants on the grounds mentioned in the<br \/>\nimpugned circular.  But the High Court found that because of<br \/>\nthe decision in Kishore Chandra Samal &amp; 39 others vs.  State<br \/>\nof  Orissa  &amp; Ors., 1992 (I) OLR 544, the persons  like\t the<br \/>\nappellants  who were serving in the octroi section could not<br \/>\nbe  brought  or\t appointed or promoted as clerks.   On\tthat<br \/>\nshort ground, the High Court set aside the promotions given.<br \/>\nFollowing  the\tsaid  Full Bench decision,  the\t High  Court<br \/>\nfurther\t directed  the Government to reconsider\t the  matter<br \/>\nwhile the promotions given had to be set aside.\t Now that we<br \/>\nhave allowed the States appeals against the decision in the<br \/>\nKishore\t Chandra  Samal\t case  in  C.A.Nos.4875-76\/92,\tthis<br \/>\nappeal\thas  to\t be allowed and the order made by  the\tHigh<br \/>\nCourt  shall  stand set aside and the reversions made  under<br \/>\nimpugned  circular  shall  stand  quashed.
