S.J. MUKHOPADHAYA)<\/p>\n<p>\t\tThis<br \/>\nappeal has been preferred by appellant Rashtriya Ispat Nigam, a<br \/>\nGovernment of India Undertaking against the order dated 23.3.2011<br \/>\npassed by learned Single Judge in Special Civil Application No.2417<br \/>\nof 2011.  By the said order, learned Single Judge dismissed the writ<br \/>\npetition and refused to direct the respondents to refund the amount<br \/>\nof octroi as was prayed by the appellant.\n<\/p>\n<p>\t\tWe<br \/>\nhave heard learned counsel for the appellant and counsel appearing<br \/>\nfor the respondent &#8211; Ahmedabad Municipal Corporation.\n<\/p>\n<p>\t\tFrom<br \/>\nthe record and finding of learned Single Judge, it would be evident<br \/>\nthat the appellant claimed refund of octroi with respect to some 3000<br \/>\nimport bills. It was alleged by respondent Ahmedabad Municipal<br \/>\nCorporation that the particulars were not supplied and claim was<br \/>\nvague.  The respondent also took plea that some of the bills are time<br \/>\nbarred and, therefore, refund cannot be made.  Learned Single Judge,<br \/>\nhaving noticed the aforesaid stand taken by respondent Corporation,<br \/>\nobserved that there is disputed questions of fact in respect of<br \/>\nimport bills, therefore, refused to exercise power under Article 226<br \/>\nof the Constitution of India.\n<\/p>\n<p>\t\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\t\tWe<br \/>\nare not inclined to interfere with the order passed by learned Single<br \/>\nJudge as it is not possible to decide the money claim as made by<br \/>\nRashtriya Ispat Nigam under Article 226 of the Constitution of India.<br \/>\nHowever, taking into consideration the fact that Rashtriya Ispat<br \/>\nNigam Limited is an undertaking of the Central Government and that<br \/>\nAhmedabad Municipal Corporation is a local authority, we are of the<br \/>\nview that they should hold meeting and settle the dispute instead of<br \/>\nforcing the appellant to move before a Civil Court of competent<br \/>\njurisdiction.  Appellant will bring to the notice of the Corporation<br \/>\neach and every bill and in a joint meeting, they will try to finalize<br \/>\nthe amount if any to be refunded or paid by the Ahmedabad Municipal<br \/>\nCorporation. Reasoned order is required to be passed by Ahmedabad<br \/>\nMunicipal Corporation if any of the claim out of the bill is not<br \/>\nentertained.  It is expected that meeting will be held between the<br \/>\nofficers both the parties in near future and the dispute will be<br \/>\nresolved amicably between the parties within reasonable period<br \/>\npreferably within three months.
