JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;7.\tThe<br \/>\npetitioner respectfully prays that, on the basis of the facts and<br \/>\ncircumstances as mentioned hereinabove and which may be urged at the<br \/>\ntime of hearing, the Honourable Court may be pleased to issue a writ<br \/>\nof mandamus or any other appropriate writ, order or direction to the<br \/>\nrespondent authorities and may be pleased to:-\n<\/p>\n<p>(A)\tquash<br \/>\nand set aside the decision of the respondent authorities of denying<br \/>\nthe appointment to the petitioner on the post of Police<br \/>\nSub-Inspector, as communicated vide letter dated 6.12.2010,<br \/>\nAnnexure-A to this petition, and <\/p>\n<p>(B)\tdirect<br \/>\nthe respondent authorities to give appointment to the petitioner on<br \/>\nthe post of Police Sub-Inspector with effect from 28.11.2010 with all<br \/>\nconsequential benefits, and <\/p>\n<p>(C)\taward<br \/>\nthe cost of the petition, and <\/p>\n<p>(D)\tpending<br \/>\nadmission and final disposal of this petition the Honourable Court<br \/>\nmay be pleased to stay the impugned decision of the respondent<br \/>\nauthorities as contained in letter dated 6.12.2010, Annexure-A to<br \/>\nthis petition, and <\/p>\n<p>(E)\tPending<br \/>\nadmission and final disposal of this petition, the Honourable Court<br \/>\nmay further be pleased to direct the respondent authorities to give<br \/>\nappointment to the petitioner on the post of Police Sub-Inspector<br \/>\npursuant to his selection, and <\/p>\n<p>(F)\tgrant<br \/>\nany other relief or pass any other order which the Honourable Court<br \/>\nmay consider as just and proper in the facts and circumstances of the<br \/>\ncase.&#8221;\n<\/p>\n<p>2.\tThe<br \/>\ncase of the petitioner is that he has been denied appointment on the<br \/>\npost of Police Sub-Inspector (Unarmed) though his name had been<br \/>\nincluded in the Select List, only on the ground that an F.I.R. had<br \/>\nbeen filed against him, without considering that the petitioner has<br \/>\nnow been acquitted by judgment dated 18.02.2010 of the Trial Court,<br \/>\nrendered in Criminal Case No.495\/2009.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Paresh Upadhyay, learned advocate for the petitioner submits that the<br \/>\ninterest of justice would be met, if the petitioner is permitted to<br \/>\nmake a representation to respondent No.2, within a period of two<br \/>\nweeks from today and the said respondent may be directed to consider<br \/>\nand decide the same, expeditiously.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tThe<br \/>\npetitioner is permitted to make a representation to respondent No.2,<br \/>\nwithin a period of two weeks from today.\n<\/p>\n<p>(b)\tIn<br \/>\nthe event that the petitioner makes a representation to respondent<br \/>\nNo.2, within the stipulated period of time, respondent No.2 shall<br \/>\nconsider and decide the same, taking into consideration the judgment<br \/>\nof acquittal passed by the concerned Criminal Court.\n<\/p>\n<p>(C)\tThe<br \/>\ndecision shall be taken, as expeditiously as possible and not later<br \/>\nthan a period of three months from the date of receipt of a copy of<br \/>\nthis order.\n<\/p>\n<p>5.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p>\t\t\t\t\t(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court R vs State on 12 January, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
