           The revision is directed against an order<\/p>\n
passed by the learned Additional District Judge,<\/p>\n
Thalassery in O.P.(Ele.)No.657\/99 awarding enhanced<\/p>\n
compensation to the respondent for the trees cut and<\/p>\n
removed and for injurious affection suffered for the<\/p>\n
drawing of overhead electric lines through her<\/p>\n
property. The respondent is hereinafter referred to as<\/p>\n
‘the claimant’. The revision has been filed with a<\/p>\n
petition to condone the delay of 369 days. Though<\/p>\n
notice was ordered to the claimant on the delay<\/p>\n
petition, despite steps taken, service could not be<\/p>\n
effected so far.\n<\/p>\n
           2.     I heard the counsel for the revision<\/p>\n
petitioner, Kerala State Electricity Board (hereinafter<\/p>\n
referred to as ‘the Board’) to consider whether<\/p>\n
C.R.P.No.1884 of 2002<\/p>\n
                        :: 2 ::\n<\/p>\n
further steps against the respondent is essential for<\/p>\n
disposal of the revision on merits, since the revision<\/p>\n
had been filed nearly eight years ago. To consider<\/p>\n
that question, the merit of the revision filed<\/p>\n
impeaching the propriety and correctness of the order<\/p>\n
impugned was also considered.\n<\/p>\n
          3. The Board had awarded compensation<\/p>\n
of Rs.21,627\/- towards the loss suffered by the<\/p>\n
claimant for the trees cut and removed from her<\/p>\n
property. She has claimed enhanced compensation of<\/p>\n
Rs.5,13,373\/-. Such claims were made in respect of<\/p>\n
the trees gut and removed and also towards<\/p>\n
diminution of land value by the drawing up of the<\/p>\n
lines. Admittedly, the Board has given compensation<\/p>\n
only for the loss suffered by the trees cut and<\/p>\n
removed. It is also not in dispute that the Board has<\/p>\n
assessed such compensation adopting annuity return<\/p>\n
of 10%.   The learned District Judge, following the<\/p>\n
guidelines in Kumba Amma v. K.S.E.B.<\/a> {2000(1)<\/p>\n
C.R.P.No.1884 of 2002<\/p>\n
                         :: 3 ::\n<\/p>\n
K.L.T. 542} re-assessed the compensation payable<\/p>\n
adopting annuity return at 5%.      On the basis of a<\/p>\n
commission report collected diminution of land value<\/p>\n
suffered by the claimant by the drawing up of the<\/p>\n
overhead lines was considered.       After entering a<\/p>\n
finding that 25 cents of property has suffered<\/p>\n
injurious affection by the lines drawn to the extent of<\/p>\n
20% both sides were directed to file statements to<\/p>\n
refix the compensation. The claimant alone filed a<\/p>\n
statement which was accepted without any objection<\/p>\n
by the Board. On the basis of the statement filed by<\/p>\n
the claimant which had been accepted by the Board<\/p>\n
as correct enhanced compensation was awarded by<\/p>\n
the learned District Judge. That order is challenged<\/p>\n
in the revision.\n<\/p>\n
           4.   When the order has been passed on<\/p>\n
consent, needless to state, no further challenge is<\/p>\n
entertainable by way of an appeal or revision.<\/p>\n
Learned counsel for the Board submitted that there<\/p>\n
C.R.P.No.1884 of 2002<\/p>\n
                        :: 4 ::\n<\/p>\n
was an error apparent in the order inasmuch as the<\/p>\n
claimant had sought for only a sum of Rs.35,000\/-<\/p>\n
towards enhanced compensation for 7 yielding<\/p>\n
coconut trees which had been cut and removed. After<\/p>\n
giving credit to the compensation already paid by the<\/p>\n
Board on the above claim she was entitled to<\/p>\n
Rs.14,000\/- only as enhanced compensation for the<\/p>\n
trees even if her claim was conceded in toto, submits<\/p>\n
the counsel.    The court below , according to the<\/p>\n
counsel, has awarded an excess amount as enhanced<\/p>\n
compensation for the trees, over and above what was<\/p>\n
claimed by the claimant. Towards injurious affection<\/p>\n
of her land, a sum of Rs.7,500\/- alone was awarded as<\/p>\n
enhanced compensation by the court, and the rest<\/p>\n
was in respect of the trees cut and removed, and to<\/p>\n
that extent the order of the court below requires<\/p>\n
modification, is the submission of the counsel. I do<\/p>\n
not find any merit in the submission as there is no<\/p>\n
material to conclude only 7 yielding coconut trees<\/p>\n

were cut and removed from the property of the<\/p>\n
claimant and the amount awarded by the Board<\/p>\n
earlier related to such trees alone. Whatever that be,<\/p>\n
if at all there was any error apparent on the face of<\/p>\n
the record, the Board should have moved a review<\/p>\n
petition within the time provided by law.<\/p>\n
            At this fag end, i.e. nearly 8 years after the<\/p>\n
filing of the revision, the ground canvassed to impugn<\/p>\n
the order which had been passed on consent cannot<\/p>\n
be entertained. There is no merit in the revision. The<\/p>\n
revision and the petition for condoning the delay are<\/p>\n
dismissed.\n<\/p>\n
