Justice ANTONY DOMINIC\n\n Dated :01\/08\/2007\n\n O R D E R\n                      Antony Dominic, J.\n             ========================\n                     O.P.No.23129 of 2000\n             ========================\n\n            Dated this the 1st day of August, 2007.\n\n                           JUDGMENT\n<\/pre>\n<p>      Petitioners who are Process Servers in different courts filed<\/p>\n<p>this Original Petition mainly to quash Ext.P1, Kerala Judicial<\/p>\n<p>Ministerial Subordinate Service Rules, 1975 to the extent Rule 10<\/p>\n<p>thereof provides that candidates belonging to Scheduled Castes\/<\/p>\n<p>Scheduled Tribes, who have passed standard VII or its equivalent<\/p>\n<p>will be considered eligible for appointment as Amin.         It is<\/p>\n<p>submitted that in terms of the Rules, the posts of Amins are to be<\/p>\n<p>filled up by direct recruitment and by promotion which is from<\/p>\n<p>Attenders and Class II employees and the petitioners are aspiring<\/p>\n<p>for promotion in that category. It is stated that the promotion<\/p>\n<p>posts available to Amin are the posts of Typist, Lower Division<\/p>\n<p><span class=\"hidden_text\">OP 23129\/00                      -: 2 :-<\/span><\/p>\n<p>Clerk, etc. for which the minimum qualification is S.S.L.C.<\/p>\n<p>According to the petitioners, if the candidates belonging to<\/p>\n<p>Scheduled Castes\/Scheduled Tribes who have not passed S.S.L.C.<\/p>\n<p>were appointed as Amins, there will not be further avenues of<\/p>\n<p>promotions for them and they will stagnate in the post.<\/p>\n<p>Consequently resultant stagnation will be caused to others also.<\/p>\n<p>It is in these circumstances that this Original Petition is filed<\/p>\n<p>seeking to quash Rule 10 of Ext.P1 as stated above.<\/p>\n<p>     2. On behalf of the eighth respondent, a counter affidavit<\/p>\n<p>has been filed in which it is stated as follows:<\/p>\n<blockquote><p>           &#8220;11. None of the grounds raised in the writ<\/p>\n<p>     petition are legally sustainable. The High Court and<\/p>\n<p>     Government have now decided to delete the proviso to<\/p>\n<p>     Rule 10 of Kerala Judicial Ministerial Subordinate<\/p>\n<p>     Service Rules, which provides for the relaxation in<\/p>\n<p>     qualification to Scheduled Caste\/Scheduled Tribes<\/p>\n<p>     candidates and Ex-servicemen for the appointments to<\/p>\n<p>     the post of Amin. The draft amendment in notification<\/p>\n<p>     form has been forwarded from the High Court to the<\/p>\n<p>     Government. The matter is under consideration of the<\/p>\n<p>     Government.\n<\/p><\/blockquote>\n<blockquote><p>           12.   Amendment to delete the proviso to Rule<\/p>\n<p>     10, of Kerala Judicial Ministerial Subordinate Service<\/p>\n<p><span class=\"hidden_text\">OP 23129\/00                     -: 3 :-<\/span><\/p>\n<p>      Rules has not yet been notified.            Until then<\/p>\n<p>      appointments could be made only as per the existing<\/p>\n<p>      rules. As such Rule 10 provides that ex-servicemen<\/p>\n<p>      and      candidates      belonging     to    Scheduled<\/p>\n<p>      Caste\/Scheduled Tribe who have passed Standard VII<\/p>\n<p>      or its equivalent will be considered eligible for<\/p>\n<p>      appointment     as  Amin.        The appointments     of<\/p>\n<p>      respondents 3 to 7 were on the basis of the above<\/p>\n<p>      provision. It is a fact that the career prospects of the<\/p>\n<p>      petitioners   are   diminished     because   of   these<\/p>\n<p>      appointments.&#8221;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>It is evident from the above that the complaint now raised by the<\/p>\n<p>petitioners before this Court has been accepted by the<\/p>\n<p>Government and remedial action is being taken and according to<\/p>\n<p>them, amendment is only to be notified.\n<\/p>\n<p>      3. In view of above, no further orders are called for in this<\/p>\n<p>Original Petition except to direct finalisation of the proceedings<\/p>\n<p>for amendment as undertaken in paragraphs 11 and 12 of the<\/p>\n<p>counter affidavit of the eighth respondent. Such process shall be<\/p>\n<p>completed by the eighth respondent within a period of six months<\/p>\n<p>from the date of receipt of a copy of this judgment.
