No.2939 of 2008\n                       -------------------------------------\n               Dated this the 4th day of August, 2008\n\n                                   ORDER\n<\/pre>\n<p>      Petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Section 302 I.P.C. The petitioners<\/p>\n<p>have not been arrested so far. Investigation is complete. Final<\/p>\n<p>report has already been filed. Cognizance has been taken by the<\/p>\n<p>learned Magistrate. Committal proceedings has been registered.<\/p>\n<p>The petitioners have not so far entered appearance. They have<\/p>\n<p>not been enlarged on bail.              Reckoning them as absconding<\/p>\n<p>accused, coercive processes are being initiated against the<\/p>\n<p>petitioners by the learned Magistrate.                      Such processes are<\/p>\n<p>chasing the petitioners.        The petitioners apprehend imminent<\/p>\n<p>arrest.\n<\/p>\n<p>      2.    According to the petitioners they are absolutely<\/p>\n<p>innocent. Their absence was not wilful or deliberate. They were<\/p>\n<p>not informed that they are accused in this case nor was any<\/p>\n<p>summons or notice was ever issued from any court to them. The<\/p>\n<p>petitioners are, in these circumstances, absolutely innocent. They<\/p>\n<p>had applied for anticipatory bail. Though some of the accused,<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.2939 of 2008          2<\/span><\/p>\n<p>who had applied for anticipatory bail in 2006, were granted<\/p>\n<p>anticipatory bail, the petitioners&#8217; application for anticipatory bail<\/p>\n<p>stands dismissed by Annexure-A2 order. In these circumstances,<\/p>\n<p>the petitioners now want to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail. But they apprehend that their<\/p>\n<p>application for regular bail may not be considered by the learned<\/p>\n<p>Magistrate on merits, in accordance with law and expeditiously. It<\/p>\n<p>is therefore prayed that directions under Section 482 Cr.P.C may<\/p>\n<p>be issued in favour of the petitioners.\n<\/p>\n<p>     3.    It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate   and    explain    to  the   learned    Magistrate   the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate.    I have no reason to assume that the<\/p>\n<p>learned Magistrate would not consider such application on merits,<\/p>\n<p>in accordance with law and expeditiously. Every court must do<\/p>\n<p>the same.      No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued<\/p>\n<p>in <a href=\"\/doc\/1516775\/\">Alice George v. The Deputy Superintendent of Police<\/a><\/p>\n<p>[2003(1) KLT 339].\n<\/p>\n<p>     4.    This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioners appear before<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.2939 of 2008            3<\/span><\/p>\n<p>the learned Magistrate and apply for bail after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits, in<\/p>\n<p>accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself, in the light of the decision in <a href=\"\/doc\/1158859\/\">Sukumari v.
