Chauhan, Field Investigator)\n\nDate of Hearing :         3.12.2008\n\nDate of Decision:         3.12.2008\n\n\nFACTS<\/pre>\n<p>       \u00a0<\/p>\n<p>\u00a0      By his letter of 8.1.2007, the appellant had requested for copies of records<br \/>\nof demolition done by DDA on 26.9.1981. To this, the PIO had responded vide<br \/>\nletter dated 22.1.2007 informing the appellant that the records were not<br \/>\ntraceable. The appeal filed by the appellant was disposed of by Shri M.R.M.<br \/>\nRao, Director (LM) (Appellate Authority) by his order dated 2.3.2007, wherein<br \/>\nthe Appellate Authority had mentioned that the request made by the appellant<br \/>\ndid not strictly fall in the ambit of RTI Act, as he had not asked for any specific<br \/>\ninformation and had disposed of the appeal accordingly.\n<\/p>\n<p>2.   The appellant has filed the present appeal against the order of the<br \/>\nAppellate Authority.\n<\/p>\n<p>3.    The matter was heard on 3.12.2008. The appellant did not appear before<br \/>\nthe Commission. DDA is represented by Shri J.S. Chauhan.\n<\/p>\n<p>4.    It is the submission of Shri Chauhan that the demolition took place way<br \/>\nback in 1981 and the records are not tracable. I do not agree with the line taken<br \/>\nby the Appellate Authority that the appellant has not requested for any specific<br \/>\ninformation. The records of demolition, indeed, are &#8216;information&#8217; as defined<br \/>\nunder the RTI Act. It is, however, a different matter that the records are not<br \/>\navailable with the DDA.\n<\/p>\n<p>                                   DECISION\n<\/p>\n<p> 5.     As the DDA informs that the relevant records are not available, it would<br \/>\nbe expedient to direct the DDA to make fresh efforts to trace out the records and<br \/>\nif they are traced out, furnish copies thereof to the appellant within 6 weeks<br \/>\ntime.\n<\/p>\n<p>6.
