Between the petitioner and<br \/>\nthe respondent some dispute arose out of execution of work under<br \/>\nWorks Contract dated 25.06.1999. Petitioner, therefore, initially<br \/>\napproached the Gujarat Public Works Contracts Disputes Arbitration<br \/>\nTribunal by filing Arbitration Reference No. 35 of 2006. This<br \/>\nreference was disposed of by order dated 04.10.2010 holding it as not<br \/>\nmaintainable before the Tribunal. Thereupon, the petitioner issued a<br \/>\nnotice to the respondent on 19.10.2010 and besides raising several<br \/>\nclaims, also invoked arbitration clause contained in the agreement.<br \/>\nThe petitioner thereupon appointed one Shri P.T.Gaurani, Chief<br \/>\nEngineer (Retired) of Government of India as the sole Arbitrator and<br \/>\nalso called upon the respondents to appoint their arbitrator.<br \/>\nPetitioner also conveyed that if the respondents failed to do so<br \/>\nwithin thirty days, petitioner would approach Gujarat High Court<br \/>\nunder Section 11 of the Arbitration and Conciliation Act, 1996.\n<\/p>\n<p>2.\tIn<br \/>\nresponse to the said notice, the respondents replied under the<br \/>\ncommunication dated 10.02.2011 stating that respondents have selected<br \/>\nname of Shri P.MChauhan, retired Judge of the Gujarat High Court, if<br \/>\nthe petitioner consents to the same, further procedure can be<br \/>\nundertaken. The petitioner, however, through its advocate, conveyed<br \/>\non 17.02.2011 that the name suggested is not agreeable to the<br \/>\npetitioner. At that stage, the petitioner approached this Court<br \/>\nseeking to invoke the provisions of Section 11 of the Arbitration and<br \/>\nConciliation Act for appointment of the Arbitrator by the Chief<br \/>\nJustice or his delegate.\n<\/p>\n<p>3.\tIn<br \/>\nthe facts and circumstances of the case, I am of the opinion that the<br \/>\nrequest of the petitioner is required to be granted. Since the<br \/>\npetitioner and the respondent could not agree to a common name for<br \/>\nappointment of the Arbitrator, I deem it appropriate to appoint<br \/>\n                 Hon&#8217;ble Mr. C.K.Thakkar (retired) to act as Sole<br \/>\nArbitrator to resolve the dispute between the petitioner and<br \/>\nrespondent arising out of work contract dated 25.06.1999.
