\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n
The
\n\tbasis of the present proceeding is the noncompliance to the order
\n\tdated 06.07.2010 passed by this Court earlier in MCA No.1950\/09,
\n\twhereby this Court had issued the following directions –\n<\/p>\n
The
\n\trepairing and construction as declared in paras 5 & 6 of the
\n\taffidavit referred hereinabove shall be removed within one month by
\n\tthe respondents and the report shall be submitted before this Court
\n\tfor the compliance within two weeks thereafter to the Registrar of
\n\tthis Court.\n<\/p>\n
No
\n\tadditional equity shall be claimed by any of the respondents in the
\n\tsuit pending before the Trial Court on the ground that any
\n\tconstruction was made by them pending the suit, may be prior to
\n\tDistrict Court granting injunction or even thereafter.\n<\/p>\n
The
\n\trespondents shall not make any new construction as per the
\n\tundertaking given before this Court referred to in para 6 of the
\n\taforesaid affidavit.\n<\/p>\n
The
\n\trespondents shall pay Rs.5,000\/- by way of cost to the petitioners
\n\twithin 20 days from today and the amount shall be sent by Money
\n\tOrder or Demand Draft to the petitioners.\n<\/p>\n
The
\n\tundertaking shall also be filed by the respondents Nos. 2,3,4,5 and
\n\t6 within two weeks from today to comply with the earlier directions.\n<\/p>\n
Upon
\n\tfiling of the undertaking and upon compliance to the aforesaid
\n\tdirections, the further action would not be required to be taken
\n\tunder the Contempt of Court Act.”\n<\/p>\n
We
\n\tmay also state that since there is a reference to the declaration
\n\tmade in the affidavit, which came to be reproduced in the above
\n\treferred order at para 7, the same read as under –\n<\/p>\n
“7.\tToday,
\n\tthe affidavit has been filed by one Vajirbhai Ramabhai Patel in
\n\tresponse to the aforesaid order and it has been inter alia stated at
\n\tparas 5, 6 & 7 as under:\n<\/p>\n
“5.\n<\/p>\n
 We state that after the order passed by this Hon’ble Court, the
\nopponent No.2 herein i.e. Arvindbhai Lallubhai Patel has repaired the
\nslab  only covering otta of his house.  The opponent no.3 herein i.e.
\nNatubhai Lallubhai Patel had also repaired the slabs of two rooms of
\nhis house as the said slabs were on verge of falling down and
\ntherefore some cementing work was done on them to protect the house
\nmembers from heavy rain in monsoon season.  The opponent no.4 herein
\nVajirbhai Ramabhai Patel has installed door and window frames and at
\npresent because of the open house he is residing at a place where the
\ncattles are kept as there is no roof on his house.  The opponent no.5
\nherein i.e. Amratbhai Ramabhai Patel has not made any repairs
\nwhatsoever.  The opponent no.6 herein Shantaben Ramabhai Patel has
\nalso not made any repairs and she is residing with Natubhai Lallubhai
\nPatel.\n<\/p>\n

\n We undertake to abide the orders of this Hon’ble Court to remove the
\nsaid repairs as for the reasons stated hereinabove the undertaking
\ncould not be filed before this Hon’ble Court as directed.  We further
\nundertake not to put any kind of construction on the suit properties.\n<\/p>\n
7.\tWe
\npray to this Hon’ble Court to take sympathetic view in the present
\nmatter.”\n<\/p>\n
We
\n\thave heard Mr.Panchal for the petitioners and Mr.Gandhi for the
\n\trespondents.\n<\/p>\n
After
\n\tthe process was issued, further directions were given in the present
\n\tproceeding and it was undertaken on behalf of the concerned parties,
\n\tviz., Arvindbhai, Natubhai and Vajirbhai, respondents no.2, 3 and 4
\n\tthat they shall comply with the directions.  Thereafter, the
\n\tphotographs are produced which go to show that the slab over the Ota
\n\thas been removed by Arvindbhai, respondent no.2.  The slab over the
\n\ttwo rooms have been removed by Natubhai, respondent no.3 and so far
\n\tas respondent no.4 Vajirbhai is concerned, he has removed all
\n\tconstructions. The undertakings have been filed which are part of
\n\tthe record of MCA No.1950\/09.    The amount of cost as ordered by
\n\tthe Court has also been paid.\n<\/p>\n
Under
\n\tthese circumstances, we find that the earlier order date 06.07.2010
\n\tpassed by this Court has been complied with, but since there was no
\n\tcompliance prior to the initiation of the contempt proceeding by
\n\tthis Court, appropriate cost also deserves to be imposed.  We would
\n\thave further recorded the reasons, however, Mr.Gandhi for the
\n\trespondent agreed to abide by the same. Therefore, considering the
\n\tfacts and circumstances, it is directed that the respondent shall
\n\tpay the cost of Rs.5,000\/- of the present litigation to the
\n\tpetitioner which will be sent by DD\/M.O. within a period of four
\n\tweeks from today to the petitioners.\n<\/p>\n
Mr.Panchal,
\n\tlearned counsel appearing for the petitioners attempted to contend
\n\tthat the earlier order which was passed by the District Court of
\n\tmaintenance of status quo and thereafter, the further construction
\n\tmade would also constitute breach of the order and therefore, this
\n\tCourt may consider the said aspects.\n<\/p>\n
\tIn
\n\tour view, the said aspect did exist at the time when this Court
\n\tpassed the order on 06.07.2010 and at the relevant point of time,
\n\tvide direction at para 9(b) it has also been observed that no
\n\tadditional equity shall be claimed.  Under these circumstances, the
\n\tconcerned court which is seized with the proceeding of the suit
\n\tshall be in a position to pass effective order and the construction
\n\tmade if any after the order passed by the District Court would not
\n\toperate as a bar in the event the plaintiff succeeds in the suit.
\n\tAs the clarification is already made, no further clarification
\n\tdeserves to be made.\n<\/p>\n
In
\n\tview of the above, as the further cause of the petitioner would no
\n\tmore survive,  the petition shall stand disposed of accordingly.\n<\/p>\n
It
\n\twould be open to the either side to move to the concerned court for
\n\tearly hearing of the Suit.\n<\/p>\n
