No. 368\/2010\n\n12.5.2010.\n\n      Shri Anoop Saxena, learned counsel for appellant.\n\n      Heard.\n\n      In the writ appeal the legality of the Order dated\n\n21.4.2010 passed in WP No.12951\/2008 has been assailed\n\nby which the learned Single Judge has vacated the interim\n\nstay which was earlier granted.\n\n      The learned Single Judge has vacated the stay on the\n\nground that petitioner's husband raised the controversy\n\nand not the petitioner.    Prima facie the objection with\n\nregard to appointment of respondent no.7 could not be said<\/pre>\n<p>to be sustainable. The name of respondent no.7 was<\/p>\n<p>mentioned in the electoral list which fact was mentioned in<\/p>\n<p>the order impugned in the writ petition. Prima facie learned<\/p>\n<p>Single Judge has found the order of Commissioner to be<\/p>\n<p>proper as such vacated the order of stay. Dis-satisfied<\/p>\n<p>thereby the writ appeal has been preferred.<\/p>\n<p>      Having heard learned counsel appearing for the<\/p>\n<p>appellant, in our opinion, as learned Single Judge has<\/p>\n<p>assigned the reasons which prima facie appear to be<\/p>\n<p>proper, order being interlocutory one does not suffer with<br \/>\n any such illegality so as to warrant interference in writ<\/p>\n<p>appeal.\n<\/p>\n<p>        Prayer has also been made by the appellant&#8217;s counsel<\/p>\n<p>that petition itself may be directed to be decided at an early<\/p>\n<p>date.\n<\/p>\n<p>        Considering the aforesaid submission, we request the<\/p>\n<p>Single Bench to decide the writ petition as early as possible.<\/p>\n<p>No case is made out so as to grant status quo. No case for<\/p>\n<p>interference   in writ appeal    is made out.
