HEMA, J.\n\n               ---------------------------------------------------\n                      B.A. No. 4380          of 2010\n               ---------------------------------------------------\n                Dated this 22nd day of July, 2010.\n\n\n                                   ORDER\n<\/pre>\n<p>        Petition for bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 379 and 201 of<\/p>\n<p>IPC. According to prosecution, on 7.2.2010 at about 12.30 P.M.<\/p>\n<p>petitioner committed theft of a motor cycle, which was parked<\/p>\n<p>by the side of the road and he changed its registration number.<\/p>\n<p>      3. Petitioner was taken into custody on 19.5.2010               by<\/p>\n<p>Kayamkulam police under Section 41(d) of Cr.P.C. and in the<\/p>\n<p>light of his confession, it was noticed that he committed the<\/p>\n<p>crime within the limits of Karunagappally police station and the<\/p>\n<p>case was transferred to that station. A complaint was registered<\/p>\n<p>on 20.2.2010 in respect of theft which took place on 7.2.2010.<\/p>\n<p>      4. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is innocent of the allegations made. He is in custody since<\/p>\n<p>19.5.2010. There is long delay in lodging the complaint.<\/p>\n<p>petitioner is only 18 years old. It is also submitted that<\/p>\n<p>petitioner is in custody for the             past 63 days. Petitioner is<\/p>\n<p><span class=\"hidden_text\">[B.A.No.4380\/2010]                 2<\/span><\/p>\n<p>seeking admission to the Engineering course and he could<\/p>\n<p>not go for counselling because he was in jail.<\/p>\n<p>      5. Learned Public Prosecutor submitted that petitioner is<\/p>\n<p>involved in other cases also of similar nature. Three cases are<\/p>\n<p>already registered against him. His arrest in this case was<\/p>\n<p>recorded when he was taken into custody in another crime.<\/p>\n<p>However, taking into consideration the fact that charge is laid,<\/p>\n<p>he   is not opposing      this bail application,    but stringent<\/p>\n<p>conditions may be imposed to ensure his presence during trial.<\/p>\n<p>        6. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioner on conditions. Hence, the following order<\/p>\n<p>is passed :\n<\/p>\n<blockquote><p>            Petitioner shall be released on bail on his executing<\/p>\n<p>            a bond for Rs.50,000\/- (Rupees fifty thousand only)<\/p>\n<p>            with two solvent sureties each for the like sum to<\/p>\n<p>            the satisfaction of the court concerned, on the<\/p>\n<p>            following conditions :\n<\/p><\/blockquote>\n<blockquote><p>                 (i) Petitioner shall report before the S.H.O.<\/p>\n<\/blockquote>\n<blockquote><p>                      on    every   Monday    and    Thursday<\/p>\n<p>                      between 10 a.m. and 1 p.m. If the<\/p>\n<p>                      petitioner seeks to get exemption<\/p>\n<p>                      from appearance before the S.H.O. on<\/p>\n<p><span class=\"hidden_text\">[B.A.No.4380\/2010]                  3<\/span><\/p>\n<p>                       any day, in connection        with   his<\/p>\n<p>                       education, he may make application<\/p>\n<p>                       in    advance    before   the   learned<\/p>\n<p>                       Magistrate and seek orders.<\/p>\n<\/blockquote>\n<blockquote><p>                 (ii)  Petitioner shall not leave the limits of<\/p>\n<p>                       the police station within which crime<\/p>\n<p>                       is   registered,   except   with  prior<\/p>\n<p>                       permission of the learned Magistrate.<\/p>\n<\/blockquote>\n<blockquote><p>                 (iii) Petitioner   shall  not   influence  or<\/p>\n<p>                       intimidate any witness or tamper with<\/p>\n<p>                       evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 (iv)  In case the petitioner is involved in<\/p>\n<p>                       any offence of similar nature, his bail<\/p>\n<p>                       is liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><\/blockquote>\n<p>            Petition is allowed.<\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                        K.
