SAHAI)<\/p>\n<p>1.\tHeard<br \/>\nMr.N.J.Shah, learned Assistant Government Pleader for the appellants<br \/>\nand Mr.A.S.Supehia, learned counsel appearing for the respondent.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the case are that the father of the respondent was<br \/>\nworking as a Second Grade Head Constable in State Reserve Police<br \/>\nForce, Group 9, Vadodara.  He died in harness on 17.7.2001.  The<br \/>\nrespondent made an application on 21.12.2002 for compassionate<br \/>\nappointment. The said application was rejected by the respondents on<br \/>\n28.7.2005 and this fact was informed to the respondent-petitioner on<br \/>\n28.7.2005 on the ground that the respondent was not possessing SSC<br \/>\nqualification.\n<\/p>\n<p>3.\tIn<br \/>\npara 7 of the further affidavit filed on behalf of the respondent, it<br \/>\nhas been mentioned that the application of the appellant dated<br \/>\n29.9.2001 was not considered as it was signed by the mother of the<br \/>\nappellant. When the beneficient Scheme for compassionate appointment<br \/>\nwas framed by the State Government on 10.3.2000, the intent was that<br \/>\nit would  assist the family of the deceased to cope with unexpected<br \/>\ncritical financial situation by giving compassionate appointment to<br \/>\none member of the dependent family of the employee who died during<br \/>\nservice leaving the family in helpless condition without any means of<br \/>\nlivelihood. No income limit was applicable for securing compassionate<br \/>\nappointment under the Scheme. The scheme was applicable only to the<br \/>\nmember of dependent family of Class-III and Class-IV employees who<br \/>\nhad been appointed on regular basis and who had put in at least five<br \/>\nyears of service and died during service. The scheme was also<br \/>\napplicable to the employees who were employed in the workcharged<br \/>\nestablishment.\n<\/p>\n<p>4.<br \/>\n The scheme provided the eligibility criteria wherein it was provided<br \/>\nthat for the post of Class-IV, candidate who possesses educational<br \/>\nqualification of Std.IV to IX were eligible for compassionate<br \/>\nappointment.  Para 7(A) of the scheme provided that compassionate<br \/>\nappointment shall be made on regular vacancies available on permanent<br \/>\nbasis. Para 8(A) of the scheme provided that, an application for<br \/>\ncompassionate appointment shall be made immediately after the death<br \/>\nof the employee concerned and the application was required to be made<br \/>\nwithin three months from the date of the death of the employee.  Any<br \/>\napplication made after the period of three months was not to be<br \/>\nconsidered in any circumstances. Since time limit was fixed by the<br \/>\nscheme, the scheme took care that the family of the deceased which is<br \/>\nin penury should not suffer for indefinite period and that is why in<br \/>\nthe scheme, the procedure was mentioned as to how compassionate<br \/>\nappointment would be provided.  It is relevant to extract the<br \/>\nprocedure provided in para 11(A) to 11(N) of the Scheme dated<br \/>\n10.3.2000, which reads as under:\n<\/p>\n<p>&#8220;11(A) For<br \/>\nconsidering the case of compassionate appointment, full<br \/>\nresponsibility is entrusted to the Additional Chief Secretary\/<br \/>\nPrincipal Secretary\/ Secretary in the case of the respective<br \/>\ndepartment of Sachivalaya and respective Heads of departments in case<br \/>\nof other employee that as soon as the employee concerned dies, the<br \/>\napplication form prescribed for securing compassionate appointment as<br \/>\nper Appendix-2 appended herewith is sent by the department of<br \/>\nSachivalaya\/department\/office in which the deceased employee had been<br \/>\nserving at the time of death, to the responsible member of the<br \/>\ndependent family and get completely complied and filled with<br \/>\nnecessary declaration\/ under-taking latest by one month.\n<\/p>\n<p>(B)\tFor the respective<br \/>\ndepartment of Sachivalaya\/ department\/ office, the knowledge-able<br \/>\nresponsible officer\/employee should be deputed immediately to take<br \/>\npersonal visit of the dependent family for this or the applicant<br \/>\nmember of the family eligible for compassionate appointment along<br \/>\nwith the responsible member of the dependent family should be called<br \/>\nimmediately in person and elucidation and guidance about this scheme<br \/>\nof giving compassionate appointments should be given and the<br \/>\nrequirements and formalities for that should be shown and advice<br \/>\nshould be given for its compliance, the application of one member of<br \/>\nthe eligible dependent family along with full compliance for securing<br \/>\ncompassionate appointment as per this scheme shall invariably be<br \/>\nobtained within the above time limit by the respective department of<br \/>\nSachivalaya in case of Sachivalaya and the Head of the department in<br \/>\ncase of other offices.\n<\/p>\n<p>(C)\tThe application from<br \/>\none eligible member of the dependent family obtained for<br \/>\ncompassionate appointment according to this schemes should be<br \/>\nscrutinized on priority basis by the respective department in the<br \/>\ncase of Sachivalaya and by head of the department in the case of<br \/>\nother offices and missing things should be got complied promptly, and<br \/>\nthe application with full compliance and necessary documents, shall<br \/>\nbe sent directly to the Gujarat Subordinate Services Selection Board<br \/>\nlatest by two months from the date of death of the employee concerned<br \/>\nby the respective department of Sachivalaya and the Head of the<br \/>\nDepartment along with their opinions. This time limit shall be<br \/>\nstrictly complied with.\n<\/p>\n<p>(D)\tOn receipt of the<br \/>\napplication by the Gujarat Subordinate Services Selection Board for<br \/>\ncompassionate appointment as above, the Board shall<br \/>\nscrutinize\/consider the same in the light of this revised scheme of<br \/>\ngiving compassionate appointment as well the orders\/instructions<br \/>\nissued by the General Administration Department of the Government on<br \/>\nthis subject. For this, one meeting of all members of the Board shall<br \/>\nbe called in second week of every month for scrutiny\/consideration of<br \/>\napplications received by the Board during the preceding month. The<br \/>\ncandidate of compassionate appointment may be called to hear in<br \/>\nperson in this meeting of the Board, if found necessary for better<br \/>\nassessment of the facts of the case.\n<\/p>\n<p>(E)\tAfter<br \/>\nscrutiny\/consideration of the candidates of the compassionate<br \/>\nappointment in this way by the Board, the Board shall, without delay,<br \/>\nrecommend\/allot the candidates selected\/ found fit for compassionate<br \/>\nappointment, to the department of Sachivalaya\/ Department\/office in<br \/>\nwhich suitable vacancy is available for compassionate appointment in<br \/>\nthe respective department of Sachivalaya\/ department\/office, after<br \/>\nfollowing the norms mentioned in above 7(E) and (F).\n<\/p>\n<p>(F)\tOn<br \/>\nrecommendation\/allotment of such candidates by the Board, in<br \/>\npursuance of the existing policy rules of the government, all<br \/>\nprocedure of recruitment like securing medical certificate of<br \/>\nphysical fitness shall be completed on priority basis, the appointing<br \/>\nauthority, the Additional Chief Secretary\/ Principal<br \/>\nSecretary\/Secretary in the case of the departments of Sachivalaya and<br \/>\nHeads of departments\/offices in the case of other offices shall give<br \/>\nthem appointments immediately.\n<\/p>\n<p>(G)\tThe Gujarat<br \/>\nSubordinate Services Selection Board shall do the work of selection,<br \/>\nrecommendation and allotment of candidates of compassionate<br \/>\nappointment on the posts of class IV besides class III.\n<\/p>\n<p>(H)\tIn the cases of<br \/>\ndeceased employee of the Panchayat Service, for considering<br \/>\ncompassionate appointment the full responsibility is entrusted to the<br \/>\nDistrict Development Officer concerned that as soon as the employee<br \/>\nconcerned dies, the application form prescribed for securing<br \/>\ncompassionate appointment as per Appendix-2 appended herewith is sent<br \/>\nby the office in which the deceased employee had been serving under<br \/>\nthe various Panchayats, to the responsible member of the department<br \/>\nfamily and get completely complied and filled with necessary<br \/>\ndeclaration\/ undertaking.\n<\/p>\n<p>(I)\tThe respective<br \/>\nDistrict Development Officer\/ Taluka Development Officer should<br \/>\ndepute any knowledgeable responsible officer\/employee immediately to<br \/>\ntake personal visit of the dependent family for this or should call<br \/>\nin person the applicant member of the family eligible for<br \/>\ncompassionate appointment along with the responsible member of the<br \/>\ndependent family, give elucidation and guidance about this scheme of<br \/>\ngiving compassionate appointment and show the requirements and<br \/>\nformalities for that and give advice in person for its compliance and<br \/>\nthe District Development Officer concerned shall invariably obtain in<br \/>\nany circumstances within above time-limit, the application of one<br \/>\nmember of the eligible dependent family along with full compliance<br \/>\nfor securing compassionate appointment as per this scheme.\n<\/p>\n<p>(J)\tThe<br \/>\n\tDistrict Development Officer concerned shall scrutinize on top<br \/>\n\tpriority basis, the application obtained as above from one member of<br \/>\n\tthe dependent family for compassionate appointment according to this<br \/>\n\tscheme, get missing things complied immediately, and shall send the<br \/>\n\tapplication along with full compliance and necessary documents with<br \/>\n\this necessary opinion to the Panchayats, Rural Housing and Rural<br \/>\n\tDevelopment Department of the government latest by two months from<br \/>\n\tthe date of the death of  the employee concerned. This time limit<br \/>\n\tshall be strictly complied with.\n<\/p>\n<p>(K)\tIn<br \/>\n\torder to scrutinize\/consider the application of compassionate<br \/>\n\tappointment on posts under the Panchayat services, the Additional<br \/>\n\tChief Secretary\/ Principal Secretary\/Secretary of Panchayats, Rural<br \/>\n\tHousing Department and Rural Development Department of the<br \/>\n\tGovernment shall constitute one standing committee consisting of one<br \/>\n\tchairman and two members from the Additional Secretary\/Joint<br \/>\n\tSecretary\/Deputy Secretary, thus three ex-officio members.\n<\/p>\n<p>(L)\tOn<br \/>\n\treceipt of the application by the Panchayats, Rural Housing and<br \/>\n\tRural Development Department of the government from one eligible<br \/>\n\tmember of the dependent family of the deceased employee under<br \/>\n\tPanchayat Service as above, the standing committee of that<br \/>\n\tdepartment constituted as above shall scrutinize\/consider the same<br \/>\n\tin the light of this revised scheme of giving compassionate<br \/>\n\tappointments as well as the orders\/instructions issued by the<br \/>\n\tGeneral Administration Department of the Government on this subject.<br \/>\n\tFor this, one meeting of all members of the committee shall be<br \/>\n\tcalled in second week of every month for scrutiny\/ consideration of<br \/>\n\tapplications received by the department during the preceding month.<br \/>\n\tThe candidate of the compassionate appointment may be called to hear<br \/>\n\tin person in this meeting of the committee, if found necessary for<br \/>\n\tbetter assessment of the facts of the case.\n<\/p>\n<p>(M)\tAfter<br \/>\n\tscrutiny\/consideration of the candidates of the compassionate<br \/>\n\tappoint-ments in this way, the committee shall submit its<br \/>\n\trecommendation to the Additional Chief Secretary\/Principal<br \/>\n\tSecretary\/ Secretary of the department for approval. After the<br \/>\n\tapproval of the Additional Chief Secretary\/ Principal Secretary\/<br \/>\n\tSecretary is secured on the recommendation of the committee, the<br \/>\n\tdepartment shall, in pursuance of the norms mentioned in above 7(G)<br \/>\n\tof the candidates selected\/found fit for compassionate appointment,<br \/>\n\tmake allotment without delay to the office of the respective<br \/>\n\tDistrict Development Officer under whose control the vacancy<br \/>\n\tsuitable for compassionate appointment is available.\n<\/p>\n<p>(N)\tOn<br \/>\n\tallotment of such candidates by the Panchayats, Rural Housing and<br \/>\n\tRural Development Department, in pursuance of the existing policy<br \/>\n\trules, all procedure of recruitment like securing medical<br \/>\n\tcertificate of physical fitness shall be completed on priority basis<br \/>\n\tand the District Development Officer concerned shall give them<br \/>\n\tappointment immediately.&#8221;\n<\/p>\n<p>5.\tFrom<br \/>\nthe bare perusal of the procedure, it is clear that it was the<br \/>\nresponsibility and duty of the Officer or Head of Department as soon<br \/>\nas the employee died in harness to immediately depute a person from<br \/>\nhis office to go and meet the dependent family. And depute a<br \/>\nresponsible officer\/employee to make a personal visit to the<br \/>\ndeceased&#8217;s family and get the application form for compassionate<br \/>\nappointment filled on the prescribed form by guiding the depending<br \/>\nfamily as to how the application form is to be filled. A further duty<br \/>\nhad been cast upon the Officer concerned to get the formalities<br \/>\ncompleted within a period of two months from the date of death of the<br \/>\nemployee and send it to the concerned authority empowered to grant<br \/>\ncompassionate appointment. The scheme further mandates that the time<br \/>\nlimit of two months had to be strictly complied.\n<\/p>\n<p>6.\tParagraph<br \/>\n11(E) read with paragraph 7(E) and (F) further secures the interest<br \/>\nof the dependent of the deceased when it in unequivocal terms lays<br \/>\ndown that if there was no vacancy in the office or department where<br \/>\nthe deceased was serving then compassionate appointment be provided<br \/>\non available vacancy for compassionate appointment falling in any<br \/>\ndepartment of Sachivalaya\/ department\/office under the State<br \/>\nGovernment.\n<\/p>\n<p>7.\tHow<br \/>\nthe laudable object of a beneficient scheme  framed by the State<br \/>\nGovernment is defeated by the inaction and lacklusture approach of<br \/>\nthe Officers\/ Employees of the State Government is demonstrated by<br \/>\nthe facts of this case.\n<\/p>\n<p>8.\tHad<br \/>\nthe appellants complied with para 11 of the Government Resolution<br \/>\ndated 10.3.2000, the respondent would have got the compassionate<br \/>\nappointment, but even till date, the appellants have not complied<br \/>\nwith para 11 of the Scheme and they have rejected the application of<br \/>\nthe respondent on the ground that the Rules which earlier provided<br \/>\nqualification of Std.IX had been amended and SSC pass qualification<br \/>\nhas now been incorporated with effect from 16.3.2005.  This Court in<br \/>\nLetters Patent Appeal No.2785 of 2010  relying on the decision of the<br \/>\nApex Court had directed the authorities to consider the claim of the<br \/>\napplicant for giving compassionate appointment as the application was<br \/>\nmade prior to the amended quali-fication SSC pass which came into<br \/>\nforce on  16.3.2005 and to treat the application of the applicant<br \/>\ndated 21.12.2002 to be well within time. The delay in moving the<br \/>\napplication for compassionate appointment was due to the inaction and<br \/>\nfault of the appellants in complying with para 11 of the Scheme for<br \/>\ncompassionate appointment, the respondent was left with no option but<br \/>\nto make an application on 21.12.2002. The respondent&#8217;s application<br \/>\nwas within time and the appellants were required to consider afresh<br \/>\nthe application of the respondent in the light of observations made<br \/>\nin  this decision and decision dated 9.3.2011 in Letters Patent<br \/>\nAppeal No. 2785 of 2010 <a href=\"\/doc\/179936\/\">(State of Gujarat and ors. vs. Budhabhai<br \/>\nA. Chavda)<\/a> decided on 9.3.2010.\n<\/p>\n<p>9.\tFor<br \/>\nthe reasons given in Letters Patent Appeal No.2785 of 2010 <a href=\"\/doc\/179936\/\">(State of<br \/>\nGujarat and ors. vs. Budhabhai A.Chavda)<\/a> decided on 9.3.2011, this<br \/>\nappeal is allowed on the same terms and conditions as provided in the<br \/>\naforesaid decision dated 9.3.2011 and the appellants are directed to<br \/>\nconsider the claim of the respondent for compassionate appointment as<br \/>\nper the qualification which was Std.
