JUSTICE RAMESH KUMAR MERATHIA\n                                 ---\n          For the Petitioners          : Mr. Krishna Shankar, Advocate in all\n                                       cases\n          For the Respondents\/M.A.D.A.: Mr. Bhawesh Kumar, Advocate in all\n                                       cases\n                                 ---\n\n2\/19.2.2010<\/pre>\n<p>           It is submitted that in spite of repeated request, the claim<br \/>\n          of the petitioner(s) have not been settled\/paid.\n<\/p>\n<p>                Counsel for the M.A.D.A. submitted that in the absence of<br \/>\n          counter affidavit, he is not in a position to accept or controvert the<br \/>\n          submissions made by the petitioner(s). He further submitted that it is<br \/>\n          also to be seen whether any quarters was given to the petitioners<br \/>\n          and whether they have paid all the upto date rent\/penal rent\/ other<br \/>\n          charges etc., against occupation of quarters, and have handed over<br \/>\n          vacant possession of the quarters or not.\n<\/p>\n<p>                In the circumstances, petitioner(s) are directed to handover<br \/>\n          vacant possession of quarters, if any given to them, if not already<br \/>\n          handed over, within 30 days from today.        Only after the quarters<br \/>\n          have been vacated, if any quarters were given, the petitioner(s) may<br \/>\n          file copy of their writ petitions before respondent no. 2 &#8211; The<br \/>\n          Managing Director, Mineral Area Development Authority, Dhanbad,<br \/>\n          which will be treated as representations on their behalf.\n<\/p>\n<p>                Respondent no. 2 will pass necessary orders with regard to<br \/>\n          payment of undisputed and legally payable amount after deducting<br \/>\n any amount recoverable from the petitioner(s), along with the<br \/>\ncalculation. If any claim\/part of it is found not tenable\/payable, the<br \/>\nreasons thereof should be communicated to the petitioner(s).\n<\/p>\n<p>      This exercise should be completed within two months from the<br \/>\ndate of receipt\/production of a copy of this order.\n<\/p>\n<p>      It is made clear that this Court has not gone into the merits of<br \/>\nthe claims of the petitioner(s).\n<\/p>\n<p>      The respondents should apply this order to other similarly<br \/>\nsituated employees, so that unnecessary litigation is avoided.\n<\/p>\n<p>      With these observations and directions, this writ petition is<br \/>\ndisposed of.\n<\/p>\n<p>                                          (R.
