Keep   it   on<\/p>\n<p>                  record.\n<\/p>\n<p>                               Heard Mr.Digvijay Kumar Ojha, learned<\/p>\n<p>                  counsel appearing on behalf of the petitioner<\/p>\n<p>                  and Mrs. Indu Bala Pandey, learned Additional<\/p>\n<p>                  Public Prosecutor for the State.<\/p>\n<p>                               The petitioner, while invoking inherent<\/p>\n<p>                  jurisdiction of this Court under Section 482 of<\/p>\n<p>                  the Code of Criminal Procedure, has prayed for<\/p>\n<p>                  quashing of the order dated 14.2.2008 passed in<\/p>\n<p>                  Sessions      Trial    No.255    of    2004    by    Additional<\/p>\n<p>                  Sessions Judge, Ist Class, Buxar. By the said<\/p>\n<p>                  order,       the   learned   Judge      has       rejected      the<\/p>\n<p>                  discharge petition filed under Section 227 of<\/p>\n<p>                  the Code of Criminal Procedure on behalf of the<\/p>\n<p>                  petitioner.\n<\/p>\n<p>                               Learned   counsel    for       the     petitioner,<\/p>\n<p>                  while pressing this petition, submits that in<\/p>\n<p>                  this case though the petitioner was named in<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>the first information report as order giver,<\/p>\n<p>the police after investigation did not collect<\/p>\n<p>any   material         showing      involvement           of     this<\/p>\n<p>petitioner and thereafter, he was not sent up<\/p>\n<p>for trial. In this case, three accused persons<\/p>\n<p>were forwarded by the police to face trial. It<\/p>\n<p>was   submitted         by    learned      counsel        for    the<\/p>\n<p>petitioner that in the entire record, there is<\/p>\n<p>nothing to suggest regarding involvement of the<\/p>\n<p>petitioner. Learned counsel for the petitioner<\/p>\n<p>has argued that after commencement of the trial<\/p>\n<p>and examination of the witnesses, a petition<\/p>\n<p>was filed under Section 319 of the Code of<\/p>\n<p>Criminal        Procedure         and      thereafter,           the<\/p>\n<p>petitioner was summoned to face trial and after<\/p>\n<p>entering    into       the    appearance        at   appropriate<\/p>\n<p>stage, a petition was filed for discharge and<\/p>\n<p>the learned trial court without applying its<\/p>\n<p>mind has rejected the discharge petition filed<\/p>\n<p>by the petitioner. Accordingly, he has prayed<\/p>\n<p>to quash the order dated 14.2.2008 passed by<\/p>\n<p>Additional Sessions Judge, Ist Class, Buxar in<\/p>\n<p>Sessions Trial No.255 of 2004.\n<\/p>\n<p>           Learned counsel for the petitioner, in<\/p>\n<p>course     of    argument,        files     a     supplementary<\/p>\n<p>affidavit       sworn        on   23.6.2010.         By    way     of<\/p>\n<p>supplementary      affidavit,           learned      counsel     for<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>the     petitioner                has    brought           on     record      the<\/p>\n<p>evidence           of        P.Ws.7            and       8.       P.W.7        was<\/p>\n<p>Sub.Inspector                of     Police,          who        has    recorded<\/p>\n<p>fardbeyan of the informant and P.W.8 is also<\/p>\n<p>Sub Inspector of Police, who had conducted the<\/p>\n<p>investigation of the case. While pressing the<\/p>\n<p>evidence of P.Ws.7 and 8, learned counsel for<\/p>\n<p>the     petitioner                has        argued      that         both    the<\/p>\n<p>witnesses have not said anything against this<\/p>\n<p>petitioner.\n<\/p>\n<pre>           Mrs.              Indu        Bala         Pandey,           learned\n\nAdditional          Public              Prosecutor            appearing        on\n\n<\/pre>\n<p>behalf of the State has opposed the prayer of<\/p>\n<p>the petitioner.\n<\/p>\n<p>           Besides hearing learned counsel for the<\/p>\n<p>parties,       I    have          also       examined         the     materials<\/p>\n<p>available          on    the       record.          In   this         case,   the<\/p>\n<p>petitioner          has       brought          on     record          the    first<\/p>\n<p>information             report          of    Buxar(Town)             P.S.    Case<\/p>\n<p>No.38 of 2002 as Annexure-1. The said first<\/p>\n<p>information             report          was     registered             for     the<\/p>\n<p>offences       under          Sections          302      and      34    of     the<\/p>\n<p>Indian Penal Code and Section 27 of the Arms<\/p>\n<p>Act. As per the fardbeyan of the informant,<\/p>\n<p>there     is       specific              allegation             against       this<\/p>\n<p>petitioner that on the order being given by<\/p>\n<p>this petitioner other co-accused opened fire<br \/>\n<span class=\"hidden_text\">                     4<\/span><\/p>\n<p>and in the occurrence, one person was killed<\/p>\n<p>and one person also received fire arm injury.<\/p>\n<p>           I have also perused the impugned order.<\/p>\n<p>The learned Sessions Judge, after hearing the<\/p>\n<p>parties and examining the materials available<\/p>\n<p>on   the    record,       has     rejected          the    discharge<\/p>\n<p>petition     by     assigning         a    detailed       reason.   Of<\/p>\n<p>course, at the time of rejection of discharge<\/p>\n<p>petition as per provision contained in Section<\/p>\n<p>227 of the Code of Criminal Procedure, there is<\/p>\n<p>no requirement to assign reason, however, in<\/p>\n<p>case of discharge, it is the duty of the court<\/p>\n<p>to assign reason. It is not in dispute that<\/p>\n<p>during     trial     when       materials          were    collected<\/p>\n<p>showing involvement of the petitioner, learned<\/p>\n<p>trial      court,       while    exercising           power    under<\/p>\n<p>Section 319 of the Code of Criminal Procedure,<\/p>\n<p>had summoned the petitioner and the petitioner,<\/p>\n<p>in compliance with summon, appeared before the<\/p>\n<p>court and at the stage of charge, the discharge<\/p>\n<p>petition was filed, which was rejected by the<\/p>\n<p>impugned order.\n<\/p>\n<p>           In view of materials available on the<\/p>\n<p>record      particularly          in        view     of     specific<\/p>\n<p>allegation     made      in     the       fardbeyan,       which    has<\/p>\n<p>been exhibited as Ext.2, I am of the view that<\/p>\n<p>it is not a fit case to exercise inherent power<br \/>\n<span class=\"hidden_text\">                       5<\/span><\/p>\n<p>        of this Court under Section 482 of the Code of<\/p>\n<p>        Criminal Procedure in favour of the petitioner<\/p>\n<p>        and, accordingly, the petition stands rejected.<\/p>\n<p>                            (Rakesh Kumar,J.)<br \/>\nMd.S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Budhi Sagar Pandey vs The State Of Bihar &amp;Amp; Anr on 24 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
