Justice V.RAMKUMAR\n\n Dated :19\/01\/2007\n\n O R D E R\n\n\n                                  V.Ramkumar, J.\n\n                  ========================\n\n                               B.A.No.160 of 2007\n\n                  ========================\n\n\n               Dated this the  19th day of January, 2007.\n\n\n                                         ORDER\n<\/pre>\n<p>         Petitioners,   who   are   accused   Nos.   1   and   2   in   Crime   No.542   of<\/p>\n<p>2006   of   Kunnicode   Police   Station   for   offences   punishable   under<\/p>\n<p>Sections   451,   323,   324   and   427   read   with   Section   34   I.P.C.   and<\/p>\n<p>subsequently also registered  for  an offence punishable  under Section<\/p>\n<p>308 I.P.C., seek anticipatory bail.\n<\/p>\n<\/p>\n<p>         2.     The   learned   Public   Prosecutor   opposed   the   application<\/p>\n<p>submitting inter  alia that  the  first   accused  is  a  habitual  offender   and<\/p>\n<p>the de facto complainant had sustained grave head injuries.<\/p>\n<p>         3.     It   is   true   that   the   alleged   occurrence   took   place   on<\/p>\n<p>25.12.2006   at   7.30   p.m.   in   front   of   the   shop   of   the   de   facto<\/p>\n<p>complainant   and   he   was   struck   on   the   head   with   a   wooden   stick.<\/p>\n<p>Going   by   the   facts   and   circumstances   of   the   case,   anticipatory   bail<\/p>\n<p>cannot be granted to the petitioners.   But at the same time, I am of<\/p>\n<p>the   view   that   the   petitioners   should   be   given   an   opportunity   to<\/p>\n<p>surrender   before   the   Investigating   Officer   for   interrogation   and<\/p>\n<p>thereafter   release   on   bail   by   the   Magistrate   having   jurisdiction.<\/p>\n<p><span class=\"hidden_text\">BA 160\/06                                  -: 2 :-<\/span><\/p>\n<p>Accordingly,   the   petitioners   shall   surrender   before   the   Investigating<\/p>\n<p>Officer on any day between 22.1.2007 and 23.1.2007 for the purpose<\/p>\n<p>of custodial interrogation and recovery of incriminating material, if any.<\/p>\n<p>The   petitioner   shall   thereafter   be   produced   before   the   Magistrate<\/p>\n<p>having   jurisdiction   on   the   same   day,   who   shall   in   the   event   of   an<\/p>\n<p>application   for   bail   filed   by   the   petitioners,   release   them   on   bail   on<\/p>\n<p>appropriate conditions.\n<\/p>\n<\/p>\n<p>       This application is allowed as above.\n<\/p>\n<\/p>\n<p>                                                            V.Ramkumar,<\/p>\n<p>                                                            Judge.\n<\/p>\n<p>ess 19\/1<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saju Samuel Aged 23 vs State Of Kerala on 19 January, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 160 of 2007() 1.
